Arbitration is an alternative dispute resolution mechanism for adjudication of disputes between two parties. Arbitration is generally related to workings of special field and essentially do not involve the CrPC,CPC or IPC sections. In such situation there is a need for special courts/tribunals on the lines of income tax/sales tax tribunal and with panel of judges having qualification and expertise in the relevant field like corporate business, project management (MBA etc) and other technical areas. This will not only greatly reduce the burden on the already overloaded higher judiciary but will give a better quality of dispute redressal and save time.

I think the existing legislations are capable enough to meet all contigencies and the parties who enter into contracts if incorporates an arbitration clause then definitely it will have a wide manifestation.Luckly we have enough infra for arbitration both adhoc and institutional, the arbitration and concilliation act read with section 89-c and order 10 rule 1Ato C of the cpc will cover almost all the contigencies. So I think,if the litigants prefers arbitration instead of the regular mechanism then there will be an impetus for the ADRS in india culminating in an ADR revolution as promoted by the judiciary and recognised by the legislature. All what we need to do is to enlighten the litigants generally about the scope of the arbitration. The scope of section 9 of the arbitration act is beyond decription which ,I feel is still in infancy due to the lack f application. So, I would suggest to promote the ADRs in the existing system rather than longing for more infra........
