Yes... I'm all for it for the reason that corporations are investing huge sums of money for their growth, besides paying out huge salary packets to their employees-It is to be noted that running businesses today has become a huge problem because of political interference/vendetta and other factors- also, it has become an 'accepted' practice among the business houses to study their competitor's moves involving technology/marketing and so on for which they lure the employees with handsome benefits. Therefore, I strongly believe why the corporates should not check their employees private activities... this is accepted world wide including corporates like Microsoft and others.

It depends on situation because i never heard about any company/employer who are checking SMS messages of employees. It can happens only in the situation of doubt. And if employers don't have trust on their employees then simply make rule that "No Mobile is allowed in working Area". rather than checking Sms messages of all employees.. such a time consuming work; pure wastage of time...

If you accept a phone and/or laptop from the company, issued for professional use, then the company rules should be followed. A company has then the right to check if the rules are followed and are thereby allowed to check the devices if they suspect otherwise. If this is restricted, then the only other option for the company is to restrict the usage of the devices. In other words, if you use the devices in the way they are intended, then there should be no problems and you would not ahve any objection to these laws.

If the cell phone is provided by the employer - with sim card - for use at work, then the employer, i believe has every right to check it. If it is your personaL number, then he definitely does not have the right.

In extreme circumtances when employers have reason to believe that official data/codes etc are being sent outside the premises of the organization through sms or mobile-emails, the employers can check employees mobile device and this is not against the freedom of the employees. We all know how these high-end mobile devices are being misused. When the court say "workplace rules" is also means privacy of the official data.

Logically speaking , yes. The key words here are "if the employer genuinely has reason to distrust the employee". I would put the proviso , that since this invasion of the employee's privacy is akin to a search warrant of his house , it should be authorised by a judicial authority , either the police or the court. Prior to this , the employer should have filed a case against the suspected employee. It is a different matter whether this can be enforced or not. But implementation of a law should not come in the way of drafting it. Drafting a law is based on whether it is right or wrong , not on whether it can be implemented or not. Once we decide that it is right to draft such a law , then we can turn our minds to how we can implement it. All roads had speed limits drawn up , even before we had the means to detect overspeeding.

No. no. no. Just because, he is getting salary does not mean that, his privacy is undermined. Equipment may be , a property of the company.But, the moment, it is issued to an individual , it is his property till such time he hand-over it. He is responsible for it. Obviously , these are the additional facility that encourages individual to prefer these companies for work.

SHEER WASTE! Irrespective of violation of employee privacy, in Indian context, it will be a total infructuous and uneconomical effort on the part of the management. Besides huge additional cost of employment of separate managerial staff to check all this, the management would be doing an unproductive work more rather than productive work and may also have to start incurring continuous huge expenditure in processing with time consuming right and wrong disciplinary cases against the erring employees. The question arises, how much managerial staff the management can employ just for this purpose only?Still further, can every SMS be made only during the working hours of the employees. Law breakers are always wiser than the law makers. So, another question arises, if the employee don't make SMSs during office hours, gather just the needed information, sends SMS from home and delete the outgoing SMS, how the management would be able to detect the contents of SMSs of employees? Also, we cannot compare Indian laws and environments with those of the US, or vice versa. Unless the management provides free mobile phone facility to the employees it has no right to indulge in to the privacy of the employees.

No, it will be voilation of once privacy,except htis employees are not slaves . One thing must be clearly understood that need of employee and employer are same. An eployee need to earn and an employer also needs to earn through employees. So the employees may not be treated like this.

no way man, either it is on company controlled or personal communication medium. it is simply violation of privacy, if compny think that employee misusing the mobile or anything like that, tell him to return it but it is unfair to check sms when employee is using that.

Employees are not purchased slaves. They should have some freedom. Lack of trust is what has the highest cost and penalty for every company, but unfortunately the rascals who own companies do not have either character or the intelligence to understand the high price of low trust in their own slaves.

If the company works for a sensitive sector such as defense, may be yes. Otherwise, what is the point ? Do they keep a 24 hour spy behind their employees? Companies are run by 'artha-pisachas' (money-ghosts) and hence this situation, where employees are not trusted. A catastrophe is approaching.
