Our lives are becoming more virtual by the day with email, social networking, internet banking accounts and digital photo albums and data stored on our PCs, but what of death?

Who gets access to those passwords and usernames? 

Do you think your email, social networks and other online stuff matters a lot after death.

E mail accounts may hold important information which the individual may not have conveyed to other family members if he has died suddenly or due to some other factors. In this case, e mail accounts are important and just as property documents and other documents are important after the death of the individual, in the future, email accounts will also become important pieces of information. Additionally, email accounts may hold a chronology of data exchanged by the individual over a period of time and which may not be available to other members and which may need to be accessed over a period of time for getting specific information based on the need of the other members. Hence, under all these circumstances, email accounts become important pieces of information. Even if the information is not useful, unless the email account is accessed by other members and the contents are noted, the conclusion cannot be reached if the information available in the account is required or not. Yes. Though it not of relevance to you it matters to your family and others. For eg. when Pakistan Cricket Team Coach Bob Woolmer died his emails were considered as evidence in investigation of his case so it shows that it has legal sanctity aswell.

Though it sounds logical and reasonable to say not to worry what happens after death, there is atleast a distant possibility that the e mail account may be used/misused. Some mechanism/some thing is required to be evolved after careful consideration. I feel that it is not that simple to handle it casually.

I dont think emails has got that much importance in life, but yes email or web address and password related secrets can be shared with your loved ones.Even if that did not happened, still your nominee can get access to your acocunts.No worries i believe!

Nope it should also die a natural death after you die. What use of an email account once you are not there. By the time you are ready for the grave, you would hardly be in a shape to switch on the comp and log in to your email account leave alone inform others about it. Lets not have all these legalese thrown at each other. Suffice it to say all your identity ceases the moment you cease your life.

Hello!Sankaran Sir ,

Under the present state of affairs, an AGREEMENT of a Social or  Domestic  nature do not result in Legal Relations.

A man who has negligently slept over his rights for an undue length of time  will not be allowed to litigate . Law aids the diligent but not the indolent is the truth globally.Rearing up of claims after a distance of time  globally is not based on the principle of Law.

The established rule in Indian Law is that Benefit  is  distinguished from Liability  but not induced by personal qualifications .Whether Correspondence comprising of two or more e-mails constitute description and value  required by the law in force in India or globally ?

               Yourself,  being an Asst.  Professor  , I am sure   you are in the know of things like Death that it is a conditional promise made to humanity by God  as revealed in the Scripture that  everyday one does have short and long doses of Death called  Sleeps for completing the growth cycle . Sleeps are not the Natural Death which is permanent . Right to Die  does not exist in Economic Democracies  globally . Other things are man-made !

For now, I like to give you an idea to e-mail to the fellow-member of our TOOSTEP who is also Legal Advisor to the Allahabad High Court , Allahabad , India , which is famous for creation of legal History having set aside the election of  the then  Prime Minister , Late Mrs.Indira Gandhi for as small as a reason like errection of barricades pronounced by the late Judge J.M.L.SINHA of the Allahabad High COURT.

Unused emails, if not revived after certain fixed period, also meet with the fate of death on time to time review by the webmasters.

There is perhaps no chance of misuse of such e-mail of which the owner has died. It gets lapsed after a few weeks, if unused. But if it is a paid mail service then it takes at least an year (or quarter of an year if quarterly paid). However we need not bother about misuse.

I don't think email accounts matters a lot after death. After few days it will automatically get expired. So no need to worry whether it will be misused.
