The recent decision by the Indian commerce department has made many of the drugmakers in the country to criticise the report, where the commerce ministry’s decision to accept the Mashelkar committee’s revised report that recommends not to restrict patenting to new drugs.

With the adoption of Mashelkar's report it suggests that it will allow patenting with incremental innovation if it provides therapeutic benefits, which allows Multinationals to allow patents by doing minor technical innovation and thus blocking competition from the Indian counterpart.

As all the drugmakers in India were into developing the same drugs of multinationals in a different manner would find it difficult now as they will not be able to do that more.

So is it justified that Drugmakers in the country are criticising the Mashelkar report?

I think yes, they are right in protesting against this Mashelkar report as many of the multinationals bring the drug and sell it here at a very high price rate which cannot be afforded by the common man and Indian drug makers were doing some minor changes and were acquiring the patents for the same drug but would be available at an affordable price for the consumer, but then with this report getting approved by the Indian commerce department it will be difficult for them to comeout with new drugs that are needed in the market and this will indeed create a problem.s

yes i do agree with u Bindu mam.. protesting against the mashelkar is indeed right way to SAVE us from SO MANY PROBLEMS RELATED TO THE DRUG DISCOVERY

I also think the same. This is not bad for the industry.Rather its good for indian companies also.As we all know from the last many yrs indian companies are enjoying the patent free market in india but did not utilised the money generated to help human kind through research.Now the industry has to change the gears and contribute through R&D.Some companies have already started the effort and have come out successfully like glenmark,biocon etc..The molecules from the said companies will hit the market somtime in future.Now these molecules are also the improvement on the existing ones.So they wont be able 2 enjoy monopoly in india.Hence the fruits of huge investment wont come to the companies.In fact we got to graduate from generics to patent holding companies.And we can produce only the incremental products rt now as the industry is in infancy stage.We got to encourage these companies so that they reach the nxt stage of noval discovery.Hope that time will come soon with such kind of efforts.
