Then why have the Executive and the legislature. Scrap it and let the Judiciary run the country. This snow-white clean jurists will make the system clean and transparent. I am sure if you take a reality check and look around you will find the Judiciary is as corrupt if not more than other institutions. Further to compound it political and coparate considerations go a long way on the appointment in Judges.

Try and push a file in the lower division courts without paying a bribe. It will be a revelation for those who see the Judiciary as angels fallen from heaven. I would rather prefer to maintain the check and balances that empowers all three pillars of our democracy but does not demonize any.

Finally like in the case of Team Anna, the judiciary which has been largely seen by the vast majority as clean institution (though I am convinced it is not true) will begin to loose it creditworthiness if it oversteps its domain. Mark my word, With the SC getting involved in the army chief's age row, we will see what I trying to warn against in the near future.

Pro activeness of the Judiciary in executive matters is not a healthy sign for the democracy. It not only diminishes the authority of the executive but also chips away at the novelty of a judgement. Judement are meant to be reserved, bi-partician and above all judicious. Sadly we are beginning to see that all institutions of the demcracy have succeeded in destroying themselves in the last couple of years. So be it with the Judiciary. If the Legislature and the Executive can do it, Guess the Judiciary can have a go at it. Namely run the country on its own terms.

When the Government fails to carry the law and the goverment minsters themselver are the culprits, there is nothing wrong if Supreme Court has come up with such a strong verdict. Common man would be really happy after hearing such verdicts. This gives us the hope that Judiciary still exists and is till very strong. Thanks to the judges who made this decision. It is sad indeed that the ruling party, opposition, media and social groups are using corruption issues to gain mileage. Now even the Judiciary has joined in. Really it seems to be a age of degradation all institutions of our country. Nobody seems sincere to bring the crooks to book.

@ Sriniwas ji. The whole issue on 2G is viewed as the case of judicial activism, in a larger public interest as claimed by many of us. If that would be the case why the Judiciary kept a closed eye on the already issued licenses. Why not the old cases scrapped as well. Amusingly, the SC clarified on the issue that the old cases were not suit-filed against, hence not scrapped. Has not the policy of larger public interest gone for a six again.

Dear Sumeetji, After the latest judgement of Delhi court have you realized why PC was not given strictures by the government whereas D. Raja was? The Annas and Swamys will always exist for it is proof that we are a healthy democracy. And all of us has to learn to live it it. But to be swayed by the rancor of these obstructionist and perennial cynics is another.

Governance is a tough job and this UPA government with all its shortcomings is doing a real good job, in the most transparent manner ever in the history of free India.

Yes!The courts are going too far and over-reaching its jurisdiction over the last year or so. It will either compound the already existing executive paralysis or the executive will come out with all guns blazing and mark a period of conflict.

With the Legislature already in a limbo this is the last of the scenarios that India will need. Hardly the situation conducive for pro-active action and initiative.

In my personal view, the Hon'ble SC has overstepped its domain by cancelling the licenses and directing the Govt to make fresh allocations based on the auction route. The policy making is unarguably  the subject of Govt's prerogative and as such, the judgement given by the Hon'ble SC suggests to be a case of judicial overreach.

@Peeyush sir. Yes sir, I understand your logic.

Sir, As you know the Courts follows specific procedures. They pronounce judgements after many hearings, cross checkings, going through evidences submitted etc. Basing on these evidences, they cant come to a generalised conclusion and extend their judgements to other areas which were not brought to their notice.

For the purpose of understanding, I would like to cite a case in which the Govt. of Andhra Pradesh during 1980s made a legislation reducing the superannuation age of its employees from 58 to 55yrs. Thousands of its employees sent out of employment with this Govt. order. Some retired and some those aggrieved with the Govt. decision moved the High Court of Andhra Pradesh.  After so many hearings, the High Court of A.P., pronounced its judgement directing  the State Govt. to reinstate the employees duly paying them the arrears as well and restricted the benefits to those who moved the court.  Other employees who obeyed the Govt. orders and retired from service were not given these benefits.  

If some one asks about the fate of employee who obeyed the Govt. orders, its upto the Govt. to take a decision and Court has nothing to do with. The same rule applies here also sir.

Thanks for insight Vinoy.But I differ on this ,one appointed for a great cause cannot go in dilution mode so easily else no need for ministers IAS officers can alone dispense.Not to be 4rgtn the amounts involved in loss.

Legally it was an overstepping it being a policy matter.Yet intervention was long due,else govt. would not have acted against it's minister. It would be better ig govt also bans any rise in tarrifs like it protected consumer's interest via mnp. If Chidambaran is not be fined/taken guilty for Raja's act why should common mam pay for those 2 idiots malafide deed.

Sorry for contradicting Mr. Peeyush sir. When the Govt.is failing time and again in discharging its legitimate duties some mechanism shall be there to correct it. Proactive judiciary is trying to correct it. Let it. Its for the betterment of India's future.
