Definitly presemce of Cyber Courts will put an impact on the mind of wrong doer that now they can be penalise for their wrong. But the serious question arouse is are the people of India are ready or well aware of the Law dealing with cyber crime. Today after six decades of Independence majority of people are not aware about their fundamental rights. In my opine there is no harm in establishing Cyber Court but awareness about the cyber crime and cyber law in general public should be our first concern.

having Cyber Court is the need of thehour ,not only for the reason that it will protect the unwanted Crime , but for the reason that using fake identity ,people are committing crime in a very intellegent manner and hardly they are being traced out, therefore ,once the Cyber Court is established , the people will have to think about the consequence before they made up their mind to do the creim , therefore ,i as a High Court Practioner ,undoubtely think that , the Cyber Court is the need of the Hour.

I am a Civil Engineer with LLB and has quite good interst in such topics. I feel that the people need to be taught about the relief the can get from the cybre crimes the provisions in the cyber crime laws and procedure to approach for the relief. Punishmenet should also be indiacated to all the viewers.yes it would certainly help in resolving the cyber crimes.

Now a days india is facing a lot of cyber crime. regular courts are not enough to cope up with this. a special court will definitely help. it is true that there are less no of professionals but once it is started this problem will be solved and more professionals will be there. Firstly, its very refereshing to know that, finally, the cyber court is constituted, but at the same time, the law makers may feel difficuties in determining the jurisdiction of this Court, since, the doctrine of territorial jurisdiction is very difficult to apply in matters pertaining to cyber crimes as the culprit may be sitting at some other part of the country or may be overseas and the person aggrived is within the jurisdiction of this Cyber Court in this scenario, whether this Court has a jurisdiction or not? assuming that the Court has jurisdiction, then, whether the local police can carry out a effective investigation, sufficient to fetch punishment for the Culprit. therefore, the issue of jurisdiction and effective investgation has to find place in the constitution of these Cyber Courts. also the Policing in these matters is certainly not up to the mark as in other countries, which includes the trianing part. I say its a GOOD BEGINNING!! Let it unfold its operations and see the time taken for ruling!! That would be the measure for us to decide whether its a good sign or not. Nevertheless, its trifle too late for us to start inspite of knowing the fact that we as a country have the best software resources that the world wants. I guess its better late than never!! :)

Why not? It would certainly help. If there are less no. of professionals, we should increase their number! If judges need training, they should get it. If technocrats need legal brush up or if advocates need technical training, they should get it too. We could introduce a separate course which includes both technical and legal aspects. I have earlier also proposed a middle layer in the legal process. This will be emphasized in this context. Look at criminal cases filed. An individual files the complaint and the State handles the case. Police department investigates it. There is option for a private complaint too! Ideally in my view, an individual in a cyber crimes case should file a case online. This should be considered by a technical panel (trained in cyber law of course) with a specific brief and authority of possible mediation and settlement. Such mediation can happen through chat sites also while all concerned participate online on specified dates and times. Only if the matter is still unsettled after this, one should go through a full legal process. The cyber crimes police can take over from this stage. We need to have few cyber crimes public rosecutors who will gradually get trained and confident in handling such cases. Specialisation happens amongst investigators advocates and judges over a period of time. The private complaint criteria can also be introduced.

According to me i think this cyber court will work out fine, as till now nobody knew where to go and what to do if there was a cyber crime, if it was given to normal courts people there didn't have a clue what was going on, but then with Government coming up with its first cyber court in the Capital is a good sign and sign which shows they are moving ahead with time, and there are also plans that each region gets one such cyber court, the cyber crimes which was on the rise, but we have to wait and see how effective is this...as we don't have the personnel required for this kind of jobs and people don't know much about these kind of crimes, so tackling this situation will be difficult in first i guess...so would like to know others view on this.

No, it will not thoroughly help to solve the problem like cyber crimes. The Indian judiciary is facing the burden of lots of pending cases in various courts. So just to make Cyber court is not at all solution for the problem like cyber crimes and without making awareness about Cyber security in India and without the proper legislation to deal with Cyber Crime, only the formation of Cyber Court to handle such cases is like " A Doctor giving medicine to the patient without knowing his actual pain ".

they way and the cyber crime is being handled compared to the speed of increasing rate of crime and types of crimes . this is not enough . although any step forward is a welcome step but this is not the way it should be taken care of. i think the proper format will be the govt should select experts in tis field and then prepare a strategy. the masses must be given proper course of awareness free of cost like literacy. because the new generation is more dependent on cyber for their daily affairs including important businesses and other aspects of life. thirdly there must be a system available at hand on all corners of india. unless this topic is given serious attention by the law making bodies and polititians including the industry itself. merely opening a court at one distant place will be definitely mockereyed by the criminals.

I think cyber courts will have their task cut out as there are more than 1 trillion web addresses in the world at the moment, which means it is already exceeding the world's population and on rough calculations we can assume that there is nearly 150 websites for each person on the planet..so how will one stop cyber crime from happening...its is really difficult according to me.

I agree with Aarti here, it will be difficult as there are very lees number of professionals who know regarding cyber crimes, threre is a need of a whole new department which should come up studying more on cyber crimes and how it is done and what are the critical points that matters in these crimes, but then one can gain access in any country in internet and to stop such a crime and bring justice in this regard is very difficult..

I don't think the cyber court would be affective, just by having cyber court is not enough, we need professionals who know these things, and each region having a cyber court will make it even more difficult, as there very less people who know regarding cyber crimes and then one can't use referrals also as there are very less cases registered in this regard, so knowledge regarding this is very less, and more important is most of the Cyber crimes happen outside India, and this poses a big problem, so with many complications this cyber court would not be effective, untill we have people and professionals who know how cyber crimes are commited and can be stopped we can't solve these cyber crimes according to me.
