Who, if any demarcated to do so,  is responsible to implement enforcement procedures as per Part III of TRIPS agreement when  Intellectual Property Infringements take place in India, in the absence of lodging of complaints by an affected foreign Rights Holder?

The DIPP, in the Min of Commerce & Industry will look into allegations of infringements only if the affected Rights Holder lodges a complaint, or if there is a violation in payment of royalties under either Automatic or Government Approvals in Transfer of the concerned Foreign Technology which has resulted in unchecked and  unauthorized commercial production by counterfeit routes without  any action towards stipulated enforcements happening.
