Immovable property is a state subject and levying service tax by the centre on real-estate is unconstitutional and it will only lead to unnecessary litigations. .

How many times do they want to tax a particular item and the final burden is obviously on the customer. He has to pay stamp duty, even VAT has to be paid and now this service tax.

Government should justify this.....

The service tax on residential flats is illogical and a typical case of tax legislation done without due diligence. A builder is selling his own manufactured product i.e. a residential (not commercial) building. so, it is obvious that the builder is promoting his own product (and not franchised by someone else) that can be seen physically, as a 'Seller' and not in the capacity as that of a 'professional' or 'consultant' to sell his own products.  In case a builder promotes/advertises his products in house and that generates some customer's footfalls then will that attract a service tax for Exhibition too?

This tax is as illogical as it can be. If one buys a ready flat from the builder or on resale, then there is no service tax. It then means that it is a product, not a service. However if one books a property before or during construction and makes progress based payments to the builder, it then becomes a service! The logic escapes me.

You are right. Service Tax should not be applied to the sale of Flats. As it is every product and service is already taxed.

Just because the Government has the authority to tax does not mean that each and every penny must be squeezed from us.

Please remember that earning a lot of money is NOT wrong. Without this incentive the industry will never progress.

it is totally unjustifiable since all burden will be on customers and already high price of real estate will go further up

Service Tax was introduced with the intention to levy tax whenever some kind of service was provided. As far as residential flats are concerned, the builders do not provide any service and buyers of flats are not receiving any service because the buyers are buying absolute ownership of the property. Government is tring to introduce service tax on anything and everything, completely ignoring the fact whether there is any service or not. This is a dangerous step as service tax on capital assets is absurd. This could only be a beginning as Governement, based on the acceptance of payment of service tax on real estate, could introduce service tax on all other capital goods. It cannot be ruled out that introduction of service tax on real estate transactions could result in more transactions with black money. I don't think it is the intention of Government to encourage black money transactions.

ANY GOVT IS FULLY JUSTIFIED IN LEVYING TAXES OF ANY KIND FOR ANY PRODUCT OR SERVICE AS LONG AS THE MONEY SO GENERATED IS FRUITFULLY UTILISED.A FLAT PROMOTER OF COURSE  GIVES A HOUSE/FLAT AND IT IS BUILT USING PRODUCTS AND SERVICES OF VARIOUS  KINDS.IT IS AN UNIVERSAL TRUTH THAT THERE IS ENOUGH OF BLACK MONEY INVOLVED IN REAL ESTATE IN CONSTRUCTION INDUSTRY.
