It is a principle of jurisprudence that an accused is to assumed innocent until proven guilty. To uphold the institution of judiciary, it is essential that all accused are provided an opportunity to defend themselves. From the assassin of Indira Gandhi, Logowal, Rajiv Gandhi, the terrorists who attacked Parliament and the Akshardham temple, all have been provided a fair trial. Why should Kasab be an exception?

Besides, this is not only a national but an international issue. what are we showing the world? That we are barbaric like Pakistan and the terrorists it sponsors? That we will see Kasab hang without a trial? Is that the image of India we want the world to see?

Remember Banglore born Dr. Muhammad Haneef who's work visa was cancelled by the Australian Government because his cousins Kafeel and Sabeel Ahmed were accused of executing the Glasgow bombing. Will we be able to protect our innocent citizens if we refuse to provide a fair trial to citizens of other countries?

NO WAY he is not a person of trust. Their group did so much financial and emotional damange to India and we have proofs that he is a pakistani.

Giving him a change to have a lawyer from Pakistan, it means, we welcome pakistan to kill our people and do more damage. Not at all. This will be the biggest mistake Indian govt could do.

Pakistani's not at all. What they did to other world, now they are themselves on the same track. Talibanies are really doing good to them. Pakistan deserves that. INfact who so ever Paistani's are in India should be asked to leave India.

All accused are entitled to a free and fair trial and all accused shall be considered innocent until proved otherwise.

This is what is written in our constitution and if we do not follow the constitution then how can we consider that anybody from this world will ever look towards India for anything good. Gentlemen/ladies, this is the time to show to the world what we are, we have been hit badly but we are not like those merciless attackers, we are different. We are civilised society and adhere to what is written. Moreover, after so much attention being sought from International media, on this case from us as well as other parties, providing what is required will not only prove us as a stronger party, but this will also put weight to our other cases with our neighbourers like pakistan and china.

Be brave, let us beat them black and blue.

For Kasab to have a fair trial is the only civilized way to get the job done irrespective of the final court decision. If proven guilty, he should be punished accordingly.

The Criminal law and Constitution also provides that each accused has a right to be defended by the LAWYER OF HIS CHOICE. Further more if a Pakistani Lawyer is allowed to conduct the trial of Kasab, then the Pak will not be able to propagate that justice was not done to Kasab since a Lawyer appointed by India did not conduct the fair trial. There would be allegations that the Lawer appointed was bias even though he is a Muslim, but a patriot and subject of India. Now since the Pak has declined to provide legal assistance to his own subject, it sends signals to misguided youths in Pakistan that in the even of need their own Governmnet refuses even to recognise it own citizens. AN INDIAN OR PAKISTANI LAWYER THE FATE OF KASAB will be same, Inshallah he will go to GALLOWS.

until and unless the verdict is given by the court one has every reason to defend himself...and should be provided with a lawyer to go through the process..its because people are not letting Indian lawyers to fight the case...so they have appointed a lawyer from Pakistan...and Viktor is right here where he has given the example of Dr. Haneef's case....there should be a fair trial.......

No.. I think the indian government is supporting the terrorism ot it is not. But keeping a terrorist in the jail and making all this drama is a damn waste of time and waste of resources and waste of Money.. He should be killled in an encounter

1. As per India's constitution, our judiciary system is designed for civil and criminal cases. It is not for terrorists & charges of nature of "waging war on India".

2.As there is a provision of military courts for indisciplines in army, there should be special "Fast Track" courts to deal with terrorists. This will cut down all the delaying tactics and deliver fast verdict.

In absence of such a provision,Kasab & his lawyer are taking advantage of legal provisions to delay the case as long as possible. We all see this & understand their tactics, but can't do anything.

3.Even going by the jusiciary, there is no provision of foreigner lawyer in Indian courts. Refer the cases on British citizens in Purulia arms drop case.

4.If after such a dreadful act of terrorism also, terrorist get to live for 2-3 years more, it is gross injustice to martyrs of 26/11

We have seen, in fact it is Indian methodology of working late. Bombay blasts occured in 1993. Cases saw results just years back. What Kasaab did to Mumbai & India is well known. I am surprised to see he is still alive. Our Govt n media should have executed his guilt acceptance in media in front of World to use as evidence that it is Pakistan who had planned it. Now wht we are waiting for??? Are we making him hero to so called Jehadis who will watch him thorugh courts for another years or so & plan some dastardly act as 26/11. His wicked crime that he n his fellow terrorists grp has comitted, has no place to ask for a Lawyer. It is beyond imagination.  Did they give chance to anyone on CST, Nariman house to live atleast for the last moment??? why should we provide him facilities instead of literally killing him in public?????

Many of people  will argue on my this psot too. Infact, we India can never unite on any issue in India. that is why the people like kasab get undue importance.......

Completely agree with Jairaj ji.First of all a terrorist like Kasab has no right to undergo a fair trial because its crystal clear that he is guilty and responsible for the death of so many people.Secondly how can he request for a lawyer from pakistan after doing such a heinous crime.....And I must say that the government is being very slow in giving justice to the victims of the terrorist attack...instead Kasab should be hanged publicly in front of everyone to instill fear among rest of the terrorists to never raise an eye on India.

Agree with Mr.Japan.What is the need to provide a lawyer to a terrorist like kasab who was responsible for the lives of hundreds of people and putting a huge dent on our economy by targetting the prime locations of our country....Terrorists like these should be severely dealt with and be given a death sentence without any trial.

I say that unnecessarily wasting the time & money in this matter (Whether Kasab shall be provided with a lawyer from Pakistan?). Kasab’s case is concerned to Terrorism and Terrorism is not concerned to any state or country like LTTE, Naxalites etc. Terrorism is not recognized by any state/country. It is against to entire world & humanity and it is the international issue. Terrorists are more dangerous than wild animals. (Ex: (1) If an wild animal enters into a city/village, what we do?......... (2) If a snake enters in a house what we do?.......) as already I said theses Terrorists are more dangerous than wild animals.  

The matter of fair trial is only for humanbeings and who recognized by the state/nation.

Kasab has been caught (thank god) by our police, in our jurisdiction and that too after he gained unlawful entry into our country!!

Our judiciary and democracy has allowed Kasab to be represented. Case closed. Finish the circus, give the verdict and let the guilty pay for the sins!

it's a sheer blunder to ask for a lawyer form Pakistan.when the whole world knows how terrorism is evolving in that country,can anyone believe a lawyer will perform his duty judiciously? getting a fair trial for the accused is the different from defending for wrong reasons and wrong causes!! every country has its own law of the land and guilty should undergo the judgement system of that land.during this process the lone terrorist who has been captured alive has lost all his moral rights to ask for a lawyer from his country.another big joke is that still pakistan is in process of establishing grounds that Kasav is not a pakistani!!

Looking at the denial farce of Pak govt. it's better not to provide a Pak lawyer, we are capable and as per our constitution every accused has the right to have a lawyer to defend him / her. What ever he has been caught literally red handed so prosecute and hang him until death there is no other alternate.

Why should a accused criminal be given a lawyer from his country..? Kasab had once already applied to pakistani embassy for help but no response has come.. so when they dont want to help their citizen why should be take efforts for that.. why should we help a terrorist..??

No.. Why a lawyer from Pak??? India is giving him legal help from our Country which itself is great.. Giving the chance for Kasab to defend himself doesn't mean that a lawyer from Pakistan should defend the case. No way that should be allowed.
