In today's news I came across this article that the government has announced in Budget 2009-10 that Fringe Benefit Tax (FBT) on perks provided by employers would be abolished but its impact is going to kick in from next month with the Central Board of Direct Taxes issuing a notification on Friday which transfers the tax burden on the employee.

In case the employer has provided a car to an employee for his personal use, the entire expenses borne by the company on the running of the car and its maintenance would be liable for tax at the hands of the employee which means accommodation, car, salary of your gardener, assistant at home, watchman, your electricity, water, club, credit card and holiday bills will all be taxed on actual expenses and as per the limit specified in the new notification. In the FBT regime introduced by then finance minister P Chidambaram in 2005, perks were taxed to employers while fringe benefits enjoyed by employees were tax free but now company car, fuel allowance, driver, accommodation, furnishings, concessional fees for kids, company funded travel and the like all will be taxed.

The position of the law before the introduction of the FBT will be restored, that is the expectation of the FM subject to proposed changes, if any, hereafter in line with income tax 14th amendment Rule.

This is unfair. As it is the employees are paying considerbale amount as tax. Allowing free flight journey for relatives of ministers & taxing a perk like fuel allowance to an employee!!! Glaring injustice!!!

Mr omkar you are right, FBT was manageable but perk tax definitely burdens employees.

perks and FBT should be part of the corporate tax at the end of the day the company does all to keep its business going. but in all the cases the burden is passed on to the employee........

I agree with the concept of FBT. All income/benefit received by an Tax payee to be taxed and parks are normally given to managers and executives and top level employees and lower level staff are deprived of it. But FBT guidelines are partisan and to be modefied to include high level GOVT officials, politians and businesmen.

I agree to the proposal to tax all the perks dished out to the employess. in many cases in Indian companies there is a illegal system in operation of paying the Senior & Middle level Managers in cash on vouchers which is termed as actuals in many cases.these are hidden in the books of account of the companies on various account heads which is very difficult to figure even during audits or any dept of Govt.

The above  usually happens in the leading private companies in India which creates a seperate affluent class of people who's life style and habbits tend to be different from the managers of a PSU or a Govt Servant which in turns is responsible for bringing in the corruption and nepotism in a poor developing country like India, wherein the other class of managers try to ape the former in a society such as ours .

No doubt the Prime Minister was apt in commenting about the high salaries and perks on Indian Managers and the bad effect of creating a disparity in incomes ,lifestyle, affluence in the society.

perks aren't the necessity so ,if that gets taxed is completely fair .corporate people  voice there opinion on equitable distribution of amenities ,upliftment of poor ,development of basic infrastructure ,the concern over rising debt from golbal financial institutions for carrying out devlopment projects ,deployment of resources on civic infrastructure ,money bringing these projects to life will not rain .it has to come from taxpayers only .perhaps,there aren't many people who honestly pay there taxes,everyone wants to fall in slab with minimal tax rate or enjoy rebates under various heads .

In my opinion the basic difference between the FBT system and the current one is that taxes were earlier being picked by employers and now employees are picking up the tab, as the taxation of perquisites will be collected as tax deducted at source (TDS) from employees. Finally govt gave some relief to coporate sector during this crsis time. It will save company tax burden upto some extent.

i support the jyoti argument because fbt is better than tax on perks direclty new tax code is difficult than old one

I also disagree with this point. Already the employees have suffered a lot in the recession. Why should they be taxed for extra facilities from office side? If government wants tax from the commodity used, they could have even approached the companies. Companies can recover from the money loss they have incurred but its very difficult for a common man to recover. Our Financial Minister should have kept this point in his mind before taking the decision...

Why should an employee pay for something he is receiving from his office and office is taking care of its maintenance? After all, either he got them because for more productive work or is using it for official work. Also, already employees have already faced a recession so employers should pay the tax not the employees. Also, why not the same is done for the Politicians. They eat up a lot by way of tickets, allowances, etc. Putting them under Taxable cover, will lead to austerity and better use of Taxpayer's money..
