The importance should be in diminishing the miscarriage of justice. We have to tighten our systems in that matter. today, money and power can make a mass murder or rapist to go scot free. the real challenge is to improve our record here. Then the jail term will suffice to prevent crime. Death sentence is not the answer. further more, under todays ground reality, we could hang an innocent man due to miscarriage of justice. That would be a tragedy. We will then have blood on our hands. The challenge is to make our criminal justice system relatively error free, not execute people.

The whole concept of the president pardoning criminals itself is a fafrce because in their statement, the presidents office states that it was done on the advise of the home ministry. Then why ask the president to pardon in the first place. The authority can be vested with the home ministry itself. The question is not about whether death sentence should be abolished or not, but rather on the morality of what the president has done. When we indians are wondering on whether the presidents office should be there in the first place, what point of commenting on the morality of her action ?

yea..in sync with mr james here. DP may be used as a weapon of last resort and to be used in rarest of the rare case depending upon the merit. Bt that's what is prevailing today. The last execution may be dhanajay chatterji..06-07 yrs back during Kalam's presidency. so my point here is if the executive head of India so thinks then why not bring a motion, get consensus and get it scrapped all and out. Mass Clemency will not only affect the morale of the kins of deceased deep down but also raise flickers from unlikely qrtrs on the right of prez u/a 72 and on the role of judiciary in such caes. so..that should either scrapped all along or else to be dealt differently with due sensitivity.

As many as 35 death convicts commuted to life by Prez while invoking clemency call under Art 72 of the constitution. Among those commuted are mass murderers, rapists and brutal killers. The disposal rate as set by Prez is 200% in stark contrast with 12.5% set in the past. Has the decision gone down well among the social and political elites or it is to be termed as "Rarest of its kind" especially in light of death penalty still in vogue.

When whole world is opposing death sentence in that time if we talk about giving someone death sentence...its nt right..who we are to end the life someone...we are not god to decide about someone death its cruel and should be ended...

Thanks Peeyush for a very relevant topic. I think it is a very important step in the right direction for us as a nation. I firmly believe as long as we cannot give life we cannot take it away either.

The argument for desisting from sending people to the gallows is also based on another significant assumption. I believe that a criminal that spends a lifetime in imprisonment carries a far bigger cross to one gets instant death. I cannot say so with 100% certainty as I have not faced either situation, but I assume all will agree with this point I forward.

Further more during his imprisonment there is a likely chance the person may reform and understand the consequence of his act. I also do understand we cannot abolish death penalty as there will be extreme cases when we need to use it. But it should be used in only the very extreme.
