A minister involved in a huge scam can get out unhurt and a poor guy stealing 200 Rs stays in jail of a year. How fair is it? I know it is not fair but still law should be same for all, shouldn't it? What can we do to make it same for all? any suggestions for change?

Equality law practice

idea posted by Sarika Singh Assistant Professor, BIT

I know this is hard but this should come and we should urge for it. We need to ratice law eqaully for all. This should become practical and not remain theory. If not obeyed then system should be changed.

Well in a sense it is correct but the same should apply to everybody without cast creed or rich and poor. In our country this things will probably take another 100 years before every body is treated in same way. One of the fall out of democracy.

Mr. Murlidharan is right. "Justice delayed is justice denied." The punishment after conviction is always as per law but the law itself allows large variations depending on the judges and there is a provision for appeal / review of the punishment. However the poor are unable to derive any benefit because of their inability to meet the legal fees and court expenses. The rich get the best lawyers and escape punishment through loopholes in the system. You can say it is all due to the effects of past Karma. The system cannot be changed unless we start upholding human values.

Rs 200 can pile on to become trillions in the future if the trend is not bucked. And poor people get aaway with anything in this countryr, after reservation, after much help, and after being released every time a Crime was Committed.

Speedy trials, apt utilisation of technology, to control political influence

idea posted by Srinivas suravajhala Asst. Manager.
The judicial system has to be revamped. Necessary lower courts have to be established, sufficient number of judges to be appointed to speed up the trial. The mindset of defense lawyers has to change. Technology has to be fully utilised for speedy completion of trial in all cases. Most of the prisons are filled with undertials on whom the allegations were not yet proved in the judicial process. The political influence in policing and judicial system has to be curtailed. Article 14 of the constitution guarantees us that all citizens shall be equally protected by the laws of the country. It means that the State cannot discriminate any of the Indian citizens on the basis of their caste, creed, colour, sex, gender, religion or place of birth. But, discrimination is ruling. A sad state of affairs.

Make circumstantial evidence ineffective

The police action most of the time ingratiates to influential satraps. There are number of cases reported by news papers where domestics helps are charged and kept in police lock ups for days together. The only way out is that police working must be autonomous. They must be allowed to function freely.

its true the one handling the power and politics get the birth right to exploit the public as well as public property, let it be any money scam or physical assault case. but once a common man comes under charge of it he/she has to pay for the offence whether proved as an accussed or not. the indian police or any authorised authority is well active to take actions against the ignorant victims of law,, but tthere is nobody to protect us from those so called leaders who themself make the law and abandon it for ther own benefits....COME ON YOU NEED TO SHOW JUSTICE WITH THE WORK YOU HAVE BEEN APPOINTED AND JUSTICE TO UR SPIRIT AS WELL....

Old and out dated Law and legal system

idea posted by Shashi Kumar U Manager accounts & commercial, Mazda Concrete Products Pvt Ltd
We still use the Laws and legal which the Britishers have left here. Some of the Laws and practices are so out dated one will laugh at it. An people has no respect for such laws. I wish to cite an example here. Once i saw a police man stopping an young man for jumping the traffic light. The young man stopped the vehicle came to the police removed his wallet asking how much. That means the man is willing to pay the penalty of Rs. 50 or 100 rather than respect the Law. This is because the Law is weak and one can get away with it. If the Law was heavy and penalty more this could have happened. Our legal system is such one can just walk out of it.Our politicians are masters in exploiting the system that they can walk away from any crime. Regarding the boy why he stole because he has no alternative for living, let the government provide proper means of living then no boy will steal.
