Dear friends,

The Asian Human Rights Commission (AHRC) is calling for a legitimate investigation into the trafficking of a 14-year-old girl in Jaitpura, Varanasi, Uttar Pradesh. We have learned that local police officers initially refused to register the case of kidnapping and trafficking but that the Director General of Police did so after being contacted by a member of the AHRC; he has promised that a proper investigation will be conducted and that the perpetrators will be prosecuted. Nevertheless the AHRC is concerned due to past experience, in which obstacles have been created by the corruption of the local authorities. Successful investigations into child trafficking are a rarity in the area.

CASE DETAILS:

According to the information received from GURIA, a local human rights NGO, 14-year-old girl Maya (the name has been changed for the victim's protection), has been missing since 22 November 2009. After having unsuccessfully looked for her for weeks without any help from the local authorities, her father came to hear that she had been sold by their former landlady, through members of a gang involved in child trafficking. He tried to register a case against her but says that the officers at Jaitpura Police Station refused to comply.

Nevertheless, almost two months after the girl was first reported missing he was told that the police had recovered Maya in Mumbai and that she was staying in a children's home. When he found her the girl was clearly frightened and in shock. Only after they returned to Varanasi did she explain that she had been deceived by a man promising to marry her then sold to a stranger and raped several times.

Cases of child trafficking are very frequent in Varanasi, where children from poor families are being abducted, sold to strangers and then forced into prostitution or slavery. Though parents regularly try to lodge complaints at the police station, police officers systematically refuse to register the cases.

The UN has also documented various cases of child trafficking in Varanasi and has denounced the collusion between the legal authorities and those involved in the criminal network. In the September 2009 report of the Special Rapporteur on the sale of children, child prostitution and child pornography, several cases of child trafficking in Varanasi were reported; it acknowledged that well-known child traffickers have never been apprehended by the police, 'allegedly due to the fact that prostitution in Varanasi is a business carried out with the blessings of the local police'.

India is party to international conventions protecting children from human trafficking, forced labour and sexual exploitation. Its constitution strictly prohibits human trafficking. The Immoral Traffic Prevention Act of 1956 specifically condemns the traffic of women and girls on the purpose of sexual exploitation. Its penal code also contains provisions specifically condemning criminal activities such as kidnapping or abduction. (For more details see UAC-202-2008) Nevertheless because of rampant corruption of the police officers and the indifference of the state authorities those legal provisions have gone unheeded in Varanasi, resulting in a protection vacuum for children when it comes to kidnapping and prostitution.

Women should be defensive

We can't expect someone to help us every time. We should be self defensive and should not fall for offers which sound too good to be true. It is negligence on women's part as well when she falls for the marriage proposal with strangers. I understand this idea does not hold true for children but at least women should understand the risks for herself.

Yes. I agree with you. Just because of marriage proposal,  it can not happen. There is something wrong there.  Either , in the part of the girl's society or in the Administrations. Because,  it is too difficult to invigilate every individuals by police force. Moreover, a place like Varanasi where the influx of people are so high, it is really, a difficult task to monitor things very closely. In a big country, where the population is very high and a large numbers lie below poverty, it does happen and a few people do take advantage.

Woman needs to take care of themselves against social evils. Education is a simple thing that protect them.

This issue not only in Varanasi, The womens and girl childrens are kidnapped all over India for illegal trafficking.It is shocking that India is No.1 in this crime.

If some body loose their belonging they can recover or earn back.

But this illegal trafficking make unrecovarable wound in their life and social status. Even after rescuing, they need to life their life with fear.This is more painful than their death.

Once They got in the hand of illegal trafficketers, situation is out of control.This is most untolerable crime in the world.

We have to create public awarness on this issue. This has to be stopped at the initial stage.Not till rescue. I request your ideas and to spread as much as possible to save our girl children and Women.

Can you please give your Idea to prevent this crime. Enverybody know how much time will take for judgement and This is un recovarable loss to the women. I seen some awarness stickers in front of ATM machines in Hyderabad about safety on travelling in Public transports for women. The message given in that sticker is very clear and valuable. But the size is unnoticable and only in English not in local language. I think the awareness banners should be kept some bigger size in public places which can catch the attention with some pictures like Road safety banners.

.Public awareness, stringent law, response of Government machinery, careful parents, proper rehabilitation after recovery of such people and every thing should be done to protect women and children from such unsocial activities

It is the prime duty of Any Govt to protect senior citizen and women in particular and public in general. A Law should come in to force to take stringent action against any person/s who is responsible for such crimes. In India anything can happen eg A M.L.A rape case. a police officer dusting Mayawathi's shoe and so on and so forth

It is quite clear that trafficking exists across India. It is also true that police action is very less in such cases. It is also of less importance to them. The girl in this case is lucky to get the support of AHRC. It is difficult for organisations like AHRC alone to crack all such cases. There are numerous NGOs across the country working for such issues. I feel such orgnaisations should shoulder more responsibility in helping such victims, as they would know how to handle such situations better.
