Rapid advances in technology and liberalisation of the Indian economy has created an ideal market for people trying to misuse existing brand values that have been cultivated and nurtured over a period of time. Counterfeiting is a serious crime. The law punishes counterfeiters and those who purchase counterfeit goods (with fines and legal actions). Counterfeiting is often associated with money laundering and exploitation of child labour.

So, how to tackle this issue??

Build Loyalty

idea posted by ANAND M Freelancer, Human Resources (HR) Consulting
By this I mean companies should try to build loyalty by providing the best of the best services & products to the consumers. Thus this will help the consumers not to shift for cheap & fake products. Moreover people will be able to judge properly b/w real & fake products.

Consumers Beware!!

idea posted by Sunita Mohapatra Product/Brand Manager, Tata Motors

As end users we need to be aware of such products & should avoid falling blindly into the trap of fraudsters. If we are aware of this then such products will not get promotion & hence this might stop.

But since people are happy to ignorant about it such products are daily being sold to you & me....So, BEWARE!!

Your point is valid Veena. Companies can run campaigns & go fro ads that clearly distinguishes a real & fake product. They should do live demonstrations to educate the common masses so that they don't get cheated.

More over companies can teach how to trace special features on their products that differentiates real from fake ones...

Tough laws like name and trade mark registration needed

idea posted by Venkatraman Sales Executive/Officer, Magnum Enterprises

Ours being a potentially huge market for any novel product/technology and things like that are bound to be duplicated much faster with an aim to capture the market share.

While there are laws like trade mark registration/ patent registration etc in place to protect the industries/technologists, the laws however are cumbersome and in many cases not much action has been taken by the concerned authorities.

The only I believe people can be protected is to implement laws on the basis of 'uniqueness' of name/model/ technology etc so that any attempt to dupe consumers/end users with look alike names can be prevented.

More pertinent to note is that most duplicated originate from countries like China/HongKong/Taiwan/Malaysia and some other asian countries manufactured more or less very similar to the originals- Unless, the companies come out with special types of holograming and such other updated technologies, it will more or less be near impossible to arrest 'duplication'.

Brand owners and Governments have to act

idea posted by Ravindra Sharma Managing Consultant, CHEF-India

Brand owners through their network of distribution and consumer contact and Government through necessary laws and regulation. Leaving it entirely on customer or consumer is unfair considering overburdened judicial system.

It is not as difficult as, is made out to check and eradicate.

There are laws to govern patent, trademark, copyright and design rights. Any infringement of those rights can lead to both civil actions for compensation, injunctions, and other specific reliefs as well as criminal prosecutions for penalties like imprisonment for a term and fine. However, law as a means of regulation or deterrence alone does not seem to deliver the goods, given the laws' proverbial delays, the complexity of legislation and the expensiveness of recourse to professional assistance. We need a moral upbringing at home and in the educational institutions, social and economic pressures to conform to certain standards of behaviour in daily life and as a last resort, turn to law enforcement agencies to correct any failure to conform to the standards set.

Like we have "Jago Grahak Jago" sort of advertisement from Tata Tea to combat corruption, which has gained a lot of applause. I think the same way we want to commiunicate for duplicacy/ pracy by providing some videos. TO have videos, We can take the help of companies which are badly affected by duplicay

Balance and sound economy

idea posted by Mohammad Bakhsh Project Leader/Managing Consultant, Freelancer

The secondary market as we call it in  local parlance thrives on counterfeits, because more than half the population does not have adequate of purchase. The Indian thriving economy is doing good to big operators or players unless balancing in economy  is done, duplicacy will thrive.

Monitor the middlemen/agencies

idea posted by Venkatraman Sales Executive/Officer, Magnum Enterprises

It isa general practice in almost all spheres of sales and marketing - even cotton buds, which were originally imported from china today are duplicated locally with similar types of packings/writings etc.
The reason for such cheap duplicates flooding the market are the middlemen/agents and such others who have 'contacts' to develop cheap goods and mix with the better quality products to earn more profits-these very people also induce the retail market to push cheap duplicates for better returns in their business.

If there are laws to monitor and adequately punish such middlemen/agencies,I think duplicacy could be controlled to a larger extent.

Innovate & Educate

idea posted by Ravi Rajput Spare Parts Manager-Honda

customer education-Ex:-Maruti Genuine Parts AD and ADs persuading customers to insist on bill of purchase.also include training to channel partners as well.

if possible introduce products with various price brackets (Max. to Min)enabling maximum customers from all sections of society to associate themselves with a reputed brand.

innovative products and services-Ex-castrol introducing new products very often

expand distribution network-simple and effective technique, reach out to maximum possible customers and markets.

innovative and creative packaging which is changed periodically-Ex-,Bisleri with new bottle seal etc.

Take legal actions against counterfieter and publisize it widely- this will surely discourage many more indulging in such malpractices.
