I think today all the white collar criminals are getting scott-free, as anything can happen in India, normal people are getting punished but not these white collar criminals who form, Politicians, bureaucrats, business men and some high profile people, So, how can we nail white collar criminals??

Quick & commensurate punishment

Large-scale white-collar crimes is taking place in the country...there should be quick investigation based on data and facts and the media should not play it up. And there should be very heavy punishment which is commensurate with the benefit that those people have indeed gained. If you have quick, commensurate punishment, then things will be alright. Today, we have so many cases where elite...they just don't get punished even though they have committed huge crimes. That's the problem with this society....and due to this...the crime rates are increasing, as they are getting wrong example where these people are committing huge crimes and are getting away, so what if we do some small crime, we can easily get out of it....as one puts all those connections to work to make sure he gets away with it.

Stricter Punishment

Have very very strict punishment for offenders. This would put the fear in the minds of people who even think about committing a crime, white or any other collared crime.

For instance, seize the entire wealth of the family, both earned as well as ancestral properties (wealth). If husband commits the crime, seize the wealth of the wife and kids as well as the parents. Put the husband in prison and provide the wife, kids and parents a monthly base amount that would just keep their sustenance (food and other basic expenses). Make it mandatory to send the kids to corporation school and make it a rule that they would loose all their reservation status.

And give a large part, say 25% or 40%, of the seized wealth to the team members who catch and successfully prosecutes the person.

And have just one court, a specially designated court, to try these cases instead of a having a chain of courts right from the district court to high court and all the way to the supreme court.

The people who should catch and punish white collar criminals are already bought by them. If you have enough money, you can get away with anything in this country. Police are generally corrupt, Judges can be bought and we dont even need to consider the politicians. So, where will you get justice from? Say, by some miracle or chance, some white collar criminals get caught. What next? They stay in luxurious jail housing for a few months/years and get out on a technicality. Or if they pay enough, they dont get arrested at all. Then what? Where does the money they illegally made go? Nowhere. If it is recovered, it is half consumed by the politicians and police. For the remaining, they will form a committee to disburse it to the people... BUT they will claim that there was not enough money recovered and the people get 10-15% of what they lost. In some cases, the corporations/companies that were frauded recover the money but not all of it because they cannot admit incompetence. Unless there is a law agency independent of everything currently in place, there is no hope of truly nailing white collar criminals.

I am totally agree with you Mr. Abhijit... This is really unfortunate for India.. The whole system is affected by this cause.. As Mr. Abhijit described above you can't do anything for nailing them...

Due to paucity of judges, courts and total working days the cases keep pending and the trials get delayed. This gives the guilty more opportunities to bribe, conjure false data, and pressurize the complainant, all the while being free to commit more white collar crime.

I don't agree with the idea suggested by others to punish the wife and children, because that would be jungle raj. Also this would force people who hate victimization of women and children to fight for acquittal of the accused.

I also don't agree with the idea of community police which supersedes the police, because this sounds like a out-of-control panchayat which would overturn the law.

Let us not discount the power of punishment as given in our laws since the problem right now is in the delay of handing out these punishments.

There are two state of law, first for common man - arrest than interrogation, second for high profile white collar, interrogation and than may be not arrest, see A.Raja and Kalmadi, CBI have dual procedure as you have seen, ministers say we don't want to hurt the image of high profile people, what about the common man, has he don't have any public image?????

I do not think so that white collar criminals are living very freely. there are many examples in our judgement where white collar criminals got punished.Media is playig a vital role in it. may be our constitution delay in judgement but i belive in it. i think their should be emphasize on police force working structure, role of police should be restructure.

It is not possible to nail the shrewd white-collar criminals, as they have the expertise to book their innocent subordinates as their substitutes to be nailed down in lieu of them. Power of the white-collars itself is a source of corruption and all other ills to manipulate the things in favor of the white-collars.

1.people should have power to recall the govt. once for every 2.5 years, and also should have power to recall the elected MLA and MP if his performance is not to mark. 2. community police system should be introduced where the community policy is independent authority and supersede the powers of local police and he is supervised by the local community obviously the common people in locality/community. 3. Decision making should be decentralised and should be made by DSS systems, the political people should only for implementation. 4.Minimum 60% Voting should be their to qualify an election. Min. Post graduation is the qualification. like wise constitutional changes has to brought to change the system. we cannot change the people, but we can correct/change the system, if system is good, their will be no way to do wrong to maximum extent. unfortunately politicians has to change the system, they will never do that, since if they did they cannot conduct scams. only god has to save us.

At the last count more than 75% of our laws have no relevance in todays life. We need to urgently amend the entire judicial law in our country and make it more transparent and less complicated so that the no. of loop holes inherent are removed. A clear and precise law will lead to a higher rate of conviction and thereby reduce white collar crime.

I am sure that all White Collar Criminals have merged because we have let them emerge. Whenever we bribe or bypass a policy or a procedure to get things done, we encourage petty white collar thieves. Unintentionally or intentionally, we become part of this filth. After couple of years, the issue comes to lime light and one scapegoat is punished. Those behind the crime move freely.. I firmly believe that if we start saying NO to any jugad for getting things done, that can discourage new criminals to be formed and subsequently, curb white collar criminals also... We got to ask, how many of us are White Collar Criminals...
