India is fast emerging as a major hub of cyber-crime as recession is driving computer-literate criminals to electronic scams. Although cyber-criminal activity remained low in India compared with other emerging economies, there has been a leap in cyber-crime in recent years. One recent report ranked India in 2008 as the fourteenth country in the world hosting phishing websites.

So users, what, according to you, government should do enforce cyber laws?

Government should come out of its dominant authority for regulating criminal behaviour. It should learn from other nations and examine their current laws to discern whether they are composed in a technologically neutral manner that won't exclude the prosecution of cyber criminals. In many cases, India needs to update its current laws. Enactment of enforceable computer crime laws that also respect the rights of individuals are an essential next step in the battle against this emerging threat. Also, the weak penalties in most updated criminal statutes provide limited deterrence for crimes that can have large-scale economic and social effects. So, government should increase the penalty and duration in Jail.

cyber crime-1)not clearly defined yet in india, 2)not properly identified, 3)trial and error method is used, 4)not comunicated properly(to mass, to police), 5)strictness doesn't mean long emprisonment, havey monetry charges, but means how efficiently ''KHAKI'' and ''BLACK LONG COAT'' use it.

this topic need some more options.

Goverment should be more vigilant and strict to ISP. ISP is one who should ban and filter request coming form internet user and should notifiy maximum number of offenders to cyber crime cell.

Govt should now stop listening to freedom of everything..and start acting on crime..cyber crime.

That will not make India as China..Do not worry.

Formation of EHG ( Ethical Hacker's Group)

To tackle the increasing cyber crimes, a well organised team of ethical hackers needs to be formed. The team's main objective should be to find out the websites,ipaddresses etc. which are involved in these activities.Then they should take action after consultation with the government and the higher international bodies to totally evacuate from the cyberspace.

Existing may serve the purpose to an extent

As well there are many laws in India and not been effectively/uniformly used.  Practically speaking there are NO laws for politicians & rich people.  In such situation I'm not very certain about defining new laws to serve the purpose.

How many cyber-cafes are keeping records of visitors?  How networks are safe?  How many banks follow RBI's guidelines of online transactions?

It will only be another study material for a specialized field only.

Swift and Proper Reporting, its due Investigation, and prosecution before Court

The government cannot search out for the victims.  It is the duty of the victim to report the matter.  What government must ensure is the swift and proper investigation and appropriate prosecution before court. 

The victim, investigating authority as well as prosecution & courts deal with the case swiftly but properly to ensure enforcement of law. 

 

The delay is main cause of worry and must be done away with.

India enacted the " Laws Against Cyber Crimes" in the year 2000 well at par with developped countries where most of the provisions to punish the guilty has been incorporated.

Now, required a 'team of experts' in the enforcing agency as such crimes are becoming more and more sophisticated. The police should take help of IT experts to check such crimes.

just go through this example, go to near by police station, explain them illegal data stealing from your PC and experience cyber law.

i hope you understand what i mean.

In fact the indian laws all are outdated.....Thats why only the crimes ( they may be social crimes or cyber crimes). And there are many loopholes and backdoors in indian laws. So first of all those backdoors are need to be closed by updating the whole indian laws. After that automatically the rate of cyber crimes will be decreased.But this is not a small work. It is equl to writing the constitution. So as smita said the punishments are made strict.
