i think such criminals should be given worse than death kind of punishment because if the rule of law is death for death then think what should it be for ruining the life ot sometimes very young girl children. |

definetly, those who do not respect human life and bring disrepute and social stigma by acts like deserve highest mode of punishment that is ever possible.
worse punishment should be given, because death sentence is for every crime. and this crime is the most cruelest crime. the person should also bear the pain. death is not the only result. we should define such punishment for the crime which also effect our judiciary as well as our police system. so that in future no body even think to this type of crime in his dream also.
Punishment should be given like Arab countries but just to create a fear in their mind but after a certain stage this kind of punishment can definitely cause harm to the peace of our society,,, so i think after a certain level where this type of cases are in control , we should punish them with the best possible way where the criminal gets the proper punishment and also our civilisation remains un disturbed,,,

Without taking steps to cleanse the law enforcing bodies and judicial system, enforcing the stringent laws is not practically correct. We can not call an accused as culprit unless the allegations are proved. Once an accused proved as culprit, a fatal punishment is required to be imposed. Our Laws has too many loopholes, they have to be plugged first. |

you are right, in many case the accused are somewhere related to politicians or bureaucrats or what we call "Bahubali and Dabangg" and then the whole process of investigation becomes meaningless. If you see in UP the policemen were involved in the recent rapes, law can only become effective if it is properly enforced and executed. If the policemen, judges, politicians would start getting involved in rapes no law or sex education will help.

Though the act of rape is clearly a sexual crime, contemporary studies show that it has much more to do with the assertion of power than it does with sexual gratification. Thus, the weakest in our societies are most likely to become its victims, especially women and children.
What is interesting is that what seemingly motivates such violent "power plays" is more often than not the frustration which stems from fear of losing power or even powerlessness itself.
Likewise, we know that the occurence of rape is much less frequent in societies characterized by stable communities and traditional values. It is for this reason that we see the incidence of rape rising rapidly in developing nations and during times of economic stress.
Yes, it is society's responsibility to protect its weakest members and to punish those who prey upon the weak. But likewise, it is our responsibility to see to it that there are socially acceptable and just outlets for the disenfranchised to resolve their fears of powerlessness before they take revenge on those even more vulnerable than themselves.

I partially agree to what you have stated. I agree to the fact that rape is to establish power and a crude and sadistic way of enjoying infliction of pain to others and thus establish supremacy.
But as per a statistics United nations is the rape capital of the world. I have cut pasted what have read.
In the United States, 1.3 women are raped every minute. That results in 78 rapes each hour, 1872 rapes each day, 56160 rapes ech month and 683,280 rapes each year. 1 out of every 3 American women will be sexually assulted in her lifetime. The United States has the world's highest rape rate of the countries that publish such statistics. It's 4 times higher than Germany, 13 times higher than England, and 20 times higher than Japan. 1 in 7 women will be raped by her husband. 83% of rape cases are ages 24 or under. 1 in 4 college women have either been raped or suffered attempted rape. 1 in 12 males students surveyed had commited acts that met the legal definition of rape. Furthermore, 84% of the men who had commited such acts said what they had done was definitely not rape. 75% of male students and 55% of female students involved in acquintance rape had been drinking or using drugs. Only 16% of rapes are ever reported to the police.
India stands 56 in regards rape cases and USA 9 in case of rape . So rape has nothing much to do with social and economical status of a region, yes its is to a very limited extend a influencing factor when considering rape at a macro level

I believe a rape charged person specially with minor girl must be sent to non bailable judicial custody and he must be considered guilty unless proved innocent. People with such cases must be put into rigorous imprisonment and their basic right during imprisonment must be restricted, Like they can meet with only immediate family, no parole, no early release. In case of non-minor girl within a quick time police must be forced to decide whether it was consensual or was it a rape. based on this preliminary investigation police must proceed. people with such heinous crimes must not be allowed to walk free. At the same time we must have strict rules for femals who put rape charges due to malicious intentions. |

Punishment system is not good in India, for few crimes shoot at sight order should be issued. That too these kind of crime should not go to court, find the person and kill. |

The basic reason of such rape cases are either the rapist is mentally ill or he have no human qualities and living only like an animal. In the second case allowing the person to live in public is dangerous. In the first case accused should be treated in jail and release only after a doctor certify his fitness. The second case accused should not be allowed to live in the society and immediately lock up in a jail and award capital punishment. |

Death is one time punishment for a criminal. I think he should be kept in dark jail with no light...only boiled food should be given to him, no bed should be allowed.., he should not be taken out. Only taken out for once in a year to see sun..
Rather than that...they should not be allowed to talk to anyone....read news, watch tv etc.....
So that they can feel the pain every second, every second they should realise their act.......

Dear All Of all the rape cases filed, very few get justice. The reason is faulty evidence collection methods and very slow and painfully humiliating court procedures. The first and foremost step should be that there should be a senior and junior lady police official for recording and filing FIR in rapes in every police station. There should be a government body attached with every police station, which would be independent and would report only to courts under who's jurisdiction it comes. This independent body should be helping victim with all necessary emotional, social and legal help. Filing of false rape charges should be treated with a imprisonment of 7 years even if the same has not been demanded by accused under a false rape cases. It should be made mandatory for lower courts to dispose of rape cases within minimum of 45 days and maximum of 120 days. Neither police or media should be allowed to disclose the name of victim to general public. Clemency petition filed by accuse shall not be held back more than 6 months of clemency being so received by the president/governor. Compensation to victims shall not be less than minimum of 2 lacs under any circumstance. Compensation should be increased depending upon social status and financial background of the accused. The girl was only 10 years old. She would not even have reached puberty and may not have understood the facts of life. Also it was in a safe place for a child i.e. school premises. I live in Toronto, Canada and my children have been in the school system for 7 years. The children here are taught evasive tactics in Grade 2 or Grade 3 i.e. age 7 ot 8 years but it is assumed that schools are safe and adults are responsible enough to protect young tots.
