Constitution Allows "I Vote Not to Vote" but we as a citizen have the right to vote for the right candidate.

Did you know that there is a system in our constitution, as per the 1969 act, in section "49-O" that a person can go to the polling booth, confirm his identity, get his finger marked and convey the presiding election officer that he doesn't want to vote for anyone!

Yes such a feature is available, but obviously these seemingly notorious leaders have never disclosed it. This is called "49-O".


Why should you go and say "I VOTE NOBODY"  because, in a ward, if a candidate wins, say by 123 votes, and that particular ward has received "49-O" votes more than 123, then that polling will be cancelled and will have to be re-polled .

Not only that, but the candidature of the contestants will be removed and they cannot contest the re-polling, since people had already expressed their decision on them .

This would bring fear into parties and hence look for genuine candidates for their parties for election. This would change the way, of our whole political system , it is seemingly surprising why the election commission has not revealed such a feature to the public.

Please spread this news to as many as you know and it seems to be a wonderful weapon against corrupt parties in India, show your power, expressing your desire not to vote for anybody, is even more powerful than voting ¦ so don't miss your chance. So either vote, or vote not to vote (vote 49-O)!

Hi, Thanks Anand for sharing this as I was not aware of this at all. If there is such system then we should take benefit of this in order to raise our voice. If there is not a good candidate to fight elections at any constituency people of that area should take benefit of this system.

Sorry GUYS but this information is INCORRECT !!!
Although there is a provision under 49-O that we can choose "NOT TO VOTE" but this DOES NOT mean that if number of 49-O votes are more then the election stands cancelled.  But as a positive sign several PILs are filed to amend this !  Hope it happens some day !!

I was not aware of this. i have few doubts. As you mention that we suppose to convey to presiding officer that we opt for not to vote. But is it not given in ballot paper. If it is not given then, we are residing in india. Booth capturing, money power and muscle power was dominating over people power from last 06 decades. So this option should be available in ballot paper to make the use of it effective. 

Still information is very good and relevant at this time. i'll convey to as many as i can.

yes even i agree with soumen here that why simply waste your vote by not voting, what is the use of like going to the vote booth and say i don't want to vote, just select the best among the lot.  According to me there should be a provision for deselecting the candidate if he is not performing, as many of them on the platform are discussing this, i guess this is the best option. Its been very long as Indian politics has not evolved according to time, there should be some changes.

We all have right to vote or say not to vote.
I never saw an incident where a person been to the polling station and declared that he is not going to vote. Instead of just wasting your vote because you didn't find all the deserving candidate. You better choose at least who can be trust worthy.

How about we all go and cast no vote this time ? Will some one do that if they find that the candidate is not fit for it. ??

General elections voting will start in few days and we have to inform about this to the masses. Hope for the best, lets wait and watch who will be the next prime minister.

"49-O" does makes sense to me. If I were to exercise my right to vote responsibly, I should be making an informed choice and what if I realise that none of the candidates standing for the post from constituency is not worth it. In such a scenario, I would opt for '49-0' I think its a powerful option provided in our constitution to empower the voters but sadly in India awareness on our rights is quite low and also a majority of the people who can make use of these rights responsibly dont vote. The task of awakening these people to vote itself is so tough forget about making them realise about such a clause as "49-O". But But...somehow I have this feeling that this general election would be rememberd for its largest turnout of first time voters. I have managed to convince around 30 youngsters from my apartment complex to get their voters ID done...I think each one of us should try and influence he people we know to vote this time : )

There is merit in Abraham Paul's observation that political parties may make their supporters to manipulate ’49-0’ but there is no denial of the fact that this is a powerful weapon.  I think I can suggest a way....  We all - perhaps a few hundred thousand voters across the country could network.  We can take constituency by constituency.  Our members on the network can contribute candidates' credentials.  We should vote on the candidates in each constituency.  This could be a sample referendum on each constituency at the national level.  If ’49-0’ is cast in any constituency by this group of well-minded people, we should publicise the fact to people of the respective constituency to consider this option.  This referencum would gain credibility over a period of time but this election could be the starting point.  In my view, advantages are as follows : The members' geographic profile will be made known.  The more widespread is the member profile geographically, the better is the credibility factor and confidence that no single political party has taken the initiative.  Members profile in respect of their education, experience, knowledge indicators, service mindedness etc. can also be indexed and provided along with the referendum.    I feel we should make a start and evolve this people vote into an effective tool gradually.

Your idea is in the lines of the famous non-cooperation movements used as effective weapons by Mahatma Gandhi against the mighty oppressors. However, 'Vote Not to Vote' is an extreme step which may not bring the required results.  Because, it is more dangerous in the present era of unethical political activism, such actions would only benefit the ones you want to protest against. 
The danger is that, in many constituencies, where good quality candidates of highly service minded, uncorrupt, capable and contesting elections, who would definitely come out successful, the opponent political parties would send their people to exercise '49-0' option to nullify the results, putting the election processes across the country in total chaos.   
My view is that, it is better to join hands with like minded of your thinking to network and communicate to the general public;  truthfully, impartially and effectively without any political bias, the profile of various candidates contesting in elections and leaving it to the voters to decide. 
You may not find eligible candidates in many constituencies, but with the proposed watch dog communities becoming powerful, the political parties will be compelled to look for good quality candidates to contest elections in their tickets. In the worse situations, people also take the cue and exercise ’49-0’ option where there is chance of an undesirable person likely to win. The parties that are not capable of doing it will vanish from the scene in due course. It will definitely bring a positive change in the overall outlook in Indian politics.  

It is in this context, I have started a watchdog community named "Indian Citizens Advisory Community Organization" ICACO. Please join this community in TooStep and refer it to like minded people. With the power of Social Community networking web possibilities, I hope many such communities will come up and grow to powerful organizations.

Regardless whether you vote or not...there will definitely be a result whether you are in favour or not. Politicians pay no attention to protests...they have an agenda and you dare not get into their way. No sensible person will turn up at a polling station to declare you are not casting a vote...better you spoil the vote. However, you should not vote for corrupt leaders...it is your prerogative to decide who is the right candidate....and vote for that person. All the best for the upcoming election. We in the outside world will be watching/following to see how it goes.
