     Being part of legal profession, as a person who has seen litigation and practical difficulties, and looking at the public criticism, I am convinced that I can expose the greatness of legal profession and the true legal professionals. The greatness lies in the difficulties and also the qualities required to stand and to come-up in profession. While I deal with difficulties, I am not considering the privileged class.

The difficulties are as follows:

    1.  There is a general assumption that students who are poor in studies will take-up law.

    2.  Looking at the professionals who suffer in life to make money and looking at the standards of some of the legal professionals, there is no good opinion about legal profession among general public.

    3. From day one, a law student will be carrying a burden in his hurt based on what others say that his decision to opt law is not correct.

    4.  If a student joins the law college despite the criticism, barring national law schools and some of the good schools, he will see a different atmosphere in college where classes are rarely conducted, are effectively conducted and all the poor attendance of students.

    5. Even the lecturers or professors in law colleges may, at times, discourage the students in opting law and planning to join the profession.

    6. Only with sheer interest and involvement, normally, students will equip themselves with good qualities/knowledge while there are in college.

    7. After completing law if a student wishes to join the profession, he has to find a senior lawyer where he will be trained for some time.

    8.  With the stiff competition in legal profession and the inevitable difficulties, the senior's office also may not be conducive for a young advocate.

    9.  Normally, the senior lawyer may not pay much to his young and junior lawyers and the young and junior advocates have to depend upon their family for their survival and personal expenses too.

   10. There will be sheer pressure on young advocates from family about early settlement and marriage.

   11. The senior advocates make the juniors to do clerical job, office clerical things, getting adjournments etc. and the junior may not find time to learn something from his senior or to read law. There can be exceptions and few like the great company law practitioner and senior advocate Shri Aravind P.Dattar & Shri Shriram Panchu of Madras High Court is certainly an exception.

   12. Very rarely, junior advocates get time to do research.

   13. The young and junior advocates may not also be allowed at times by their firms or senior advocates to take-up their own cases and to make some money.

   14. If one crosses all the hurdles and come-out from senior's office as a true professional capable of handling the clients and cases independently, other problems start.

   15. It is very costly to maintain a separate office and it will be extremely difficult during initial days to maintain the office and deal with people.

   16. There will be testing time for a young lawyer who starts his own law office and he has to cross all that.

Assuming that one crosses all the difficulties and starts his own independent practice, then, he requires:

    1. to work very hard and for along hours as the profession demands.

    2. to read alot and do required research in each and every brief he takes up.

    3. to understand the human psychology and then only he will be able to handle the clients and make money.

    4. to update his knowledge, recent pronouncements and update general knowledge like what happens around the world and in the society.

    5. to maintain status despite the difficulties.

    6. to read the mind of the judge.

    7. to posses logical mind.

    8. to have good contacts with professionals and advocate clerks.

    9. to have good argumentative skills or presentation skills to present a case.

    10. to have good drafting skills.

    11. to be very quick in all his actions.

    12. to be good in time management.

    13. to sacrifice his private life and freedome to some extent.

    14. maintain good communication and contacts and he can't venture ignoring anyone.

    Thus, I know how difficult it is to come-up in legal profession and to be recognized as a successful professional. One has to undergo many difficulties and should possess many qualities to stand in this noble profession.

    It is not necessary to other professionals to posses the qualities referred to above and it may be sufficient for them if they are technically sound and adjustable as their occupation demands. Yes, it may be true for every professional to have good communication skills etc. but, those  are must for a legal professional.

    Due to the difficulties and required qualities, a lawyer will be having knowledge of many things and subjects. A lawyer, who practices consumer law, may have good understanding of medical issues like a doctor. Its an example and its true that a true professional will be having knowledge of many things and subjects.

    Thus, I can say that the greatness of legal profession lies in the difficulties one has to undergo and the qualities required come-up in profession.

Note:

  1. A person who has good financial back-up and legacy in profession may not face many difficulties.

  3. The legal profession commands great respect in developed countries like America, but, there can not be any change in the qualities required for a legal professional.

Mr. Rao, the world doesn't care how many storms you faced, it only cares if you brought your ship home. Just because the general public has an adverse opinion of lawyers in general (not without reason), classes are not conducted and seniors ill-treat the juniors and there is parental pressure to settle down and get married, does not give lawyers to behave the way they do. Where is there not pressure and problems. The only person who has no problems has been laid to rest in his grave. So, what's so great about the legal profession? It's just like any other profession like engineers, accountants, managers, etc.

1. They have to have knowledge of a gamut of disciplines, (archaic, complicated and convoluted) laws, case-laws, innumerable rules etc and should be able to recall!
2. They have to deal with all kinds of low-lifes - be it civil or crimnal practice.
3. Then there are the omni-present corruption - babus, politicans, police, (these days even judges), busineesmen.
4. Countless adjournments if the case manages to reach the court.
5. After all this if Justice survives it is a Miracle.
6. If Justice survives then most probably the Lawyer who helped it won't survive for long - professionally speaking.

Lawyer who is supposed to uphold the rule-of-law can't be successful (excepting a very small minority) if he/she does just that! Under these circumstances to keep ones integrity (leave alone ideals one has when you start off) in tact is a huge challenge. Good luck to the legal professionals - I am thankful I am not one.

"There may be occassions in your career when you may loose a case ,then behave in such a manner that you don't loose your client, Theremay be occassions in your career when you may loose a case and the client then behave in such a manner you don't loose the court.There may be occassions in your life when you may loose a case,client and the court,then behave in such a manner that you dont loose your chracter...........and I'll say that there lies the greatness of the noble service...obviously.this is comprehendable only to practising lawyers....

Looking at your photograph,  I had felt you would be quite a grey haired advocate.  When  I looked into your profile, I find you are quite young.
It is an excellent approach that you have adopted.  You are open; communicating; appreciate others opinions and through your office at the right place - you have taken the perfect step forward.  
I thank you for your appreciatory remarks.  From my side, I feel you can reach great heights in  your profession.  Company law needs open ended advocates since the cases do not fall into a routine.  All the best

I am very  much impressed at SR Sham Sundar's comment. I do know certain negative qualities of an advocate. Advocates suspect everyone and everything and they don't believe people very easily. They know the loopholes of law and as such they may concentrate more on getting what their client wants irrespective of what is true or justice. For example, if a Bank demands his customer to pay the credit card bill, the customer's advocate may advice his client to send a legal notice to the Bank alleging some defficiency etc. and in the course Bank may end-up in its effort to recovery the money from its customer. It is happenning practically. The public may criticise advocates that they are not bothered even to do unethical things for the sake of their clients. In this regard, there exist two broad theories; one supports the theory of protecting the interets of their clients and one supporting that the advocates are not supposed to do unethical things at any cost. 
Sir, I am also very much impressed at your narration of a case and it exposes your experience. I am impressed at your experience and exposure. Supreme Court too reverses its earlier judgement on an issue and it doesn't mean that the judges of Supreme Court don't know law. It happens and its a complicated issue to deal with like human relations. For example, I have done an arbitration matter. Where the tenant questions the validity of agreement itself and the land lord insists for refering the matter to Arbitration. What I felt is that when there is no valid agreement, then, the reference of dispute to Arbitration will not arise. Its my firm opinion and I have relied on a Supreme Court judgement in this regard. Many criticised my stand and they say that the validity of agreement can be decided by the Arbitrator if the dispute is referred. Likewise, different people will be having different views and perceptions on a particular issue. Judges and advocates, being humans, may commit wrong and it is the logic behind conferring overruling power to the Constitutional Courts.

very nice article raoji,every profession has merits and demerits and it is very natural.even though it is not correct to adjudge a profession by the amount of money involved or returns expected out of it,today the world has become so commercial that every thing is calculated/gauged w.r.t.money only and nobody can help.lastly i wish to say that sincere efforts and hard work will never go unrewarded and this is applicable to each profession.

All the qualities you have described are true.  Please list the negative qualities of a practicing advocate.  You will find that advocates themselves are responsible for the lack of goodwill towards their profession.  

One example.  A company supplied materials to a distributor who in turn supplied to the end-user.  Value of goods is 95 lacs.  The end-user paid 20 lacs and stopped payment of the rest.  The distributor has not only supplied this material but some more and the total dues from the end-user to the distributor is over one crore.  Manufacturer went to the end-user and asked him to make payment to him directly.  He also sent a legal notice to the distributor to recover the money.  When distributor asked the end-user for payment, end-user fished in troubled waters and told the distributor to settle the 20 lacs to the manufacturer first and then come to him for balance payment!!  The distributor had to reply to the legal notice.  One of the top advocates in Bangalore suggested reply to the notice that the manufacturer has to invoice the end-user and recover his money!!  When I questioned this advice, I was asked "whether I am a lawyer"!!

I have advised many of my clients on many cases.  One typical case, where even the erstwhile Bar Council Chairman dropped his hands down and asked my client to go to Supreme Court.  I asked my client to apply for modification of the order of the High Court.  Every advocate told my client that modification is only for minor corrections and total content can not be reversed.  I stuck to my stand and told my client that he can not hope for better verdict if he approaches Supreme Court the way the case stands.  I asked him to rectify every misconception/misinterpretation here and file the application for modification.  Even if the verdict goes against you here it does not matter but approach supreme court on the latest verdict.  

We won the case at the Karnataka High Court itself on the modification application.  

The advocate at the opposite end is the famous, brainy Uday Holla.  Before him, the opposite advocate was a person who went on to become a judge!

All this, after I insisted on our own advocate that he should file an affidavit that his office has committed a mistake in reading and reproducing a document!!  When he refused, I had to threaten him that I would file a complaint with the bar council!!

I have lot of respect for the legal profession and rule of law.  I believe that a person can get justice here.

Nice insight....Durga, but people in every profession face the same kind of situation in their lives, how is Lawyers situation different i don't understand...most of them have problems that you have suggested...but facing these hardships and come up is what it takes to be a man...thanks for the referral

lawyer is no doubt also a lier ::

but a lawyer with a sound interpretation of a clause , judgement is the most successful one ::

and in Supreme Court we have clash of ideas between the superior brains .advocates shape the destiny of the nation.

so i feel that an advocates job is full of challenges .

I think this article would be of immense help to the aspiring lawyers... more specifically to those who want to make career in litigation. These are the practical difficulties through which all the first generation lawyers go through and the worst of them is the dependency syndrome which leads to depression and breakdowns innumerable times before overcoming the initial threshold. The adverse perception about this profession is not without reasons since this profession suffers with one of the greatest disabilities i.e mediocrity. Thus if a person really wants to shine and excel in this profession then he/she must have the these mandatory virtues amongst others: 1) a very strong determination  2) high Social Intelligence(E.Q) 3)Strong Analytical mind 4) Organized, Detail oriented and Hardworking  5)voracious reader 6)high need for Achievement 7) Good presentation skills 8) a good listener  and in my opinion the most important trait required in making of an excellent lawyer is the presence of infinite confidence.

Thats the difference Viktor. Law as a profession is not looked upon as an illustrious career today. But, with the advent of world coming closer, the foreign partner may insist on having a legal department on parole or even contracted for the safe keeping. And why not?? 
I guess Mr. Vanayam, its only time and of course our law makers who are responsible to make this a noble profession! :))
