FIFA has pressed charges against organizers of an ambush marketing effort during a World Cup match between the Netherlands and Denmark in Johannesburg Monday.

World Cup 2010: Fifa under fire as spotlight stays on 'ambush advertising' : Dutch fans

'We have made charges against the organisers of the ambush marketing, not against the young women who were involved. The police is still investigating the case,' FIFA spokesman Nicholas Maingot told a press briefing Thursday.

Police detained 36 women, all dressed in short orange dresses, during the Group E game in Soccer City for the marketing effort on behalf of a Dutch rival to official World Cup beer sponsor Budweiser.

Maingot also disclosed that South Africa coach Carlos Alberto Parreira, will not be charged for his comments against Swiss referee Massimo Busacca after his team's 0-3 loss to Uruguay in a Group A match Wednesday night in Pretoria. Parreira blamed the referee for his team's defeat, but according to the FIFA spokesman, the disciplinary committee studied the comments and found no elements which violated FIFA disciplinary code.


"It is outrageous that the two women have a jail term hanging over their heads for wearing orange dresses in a football stadium. If South Africa or Fifa wants to take a company to task for an illegal marketing action, they should start judicial procedures against the company and not against ordinary citizens walking around in orange dresses."

South Africa introduced legislation to provide protection for Fifa's sponsors, who have paid an estimated $1.2billion to be associated with the tournament. With sponsors providing a third of the revenue from the event protection is seen as crucial to maintaining the value of the rights. The UK has introduced similar legislation to protect the 2012 London Olympics.

At its most draconian, such legislation gives stewards the power to prevent spectators wearing a T-shirt branded with a rival company's logo to enter a stadium.

A media reported and published the news in India, that 'they' were not only showing curves and skin, the "Logo" was kept hidden only to be shown in all OK conditions. If we appreciate "ambush marketing", we EQUALLY honor rights of the Sponsors. Let courts decide.

Great example of understanding the impact of Trade Mark. Every organization uses colors in some specific sequence and that becomes their Trade mark. No one is allowed to use the same. Huge penalty imposed on the violation.

Thanks for sharing Ms Ravali. Just by wearing a particular color does not mean that people are marketing for some company or brand. This is all very silly

In this particular context i.e. the ladies wearing the orange skirts and tops and in a Dutch Match (Orange is the official color associated with Dutch Team and they r even called Oranje), is not at all guilty and it cannot be termed as a Ambush or Parasite Marketing and if pressed charges, according to me they can be let off by the court!!.

   Marketing of the product is the FIRST RIGHT of the sponsors by all means. These womans wearing orange dresses are looking so beautiful, free and does not show any sign of AMBUSH MARKETING. FIFA is guilty.

Personally, I found all the story ridicoluous. I mean: no logos, no slogans, no announcements had been used. Simply a color remembering something (a commercial product).
Well, the line between right and wrong is thery thin, and in my opinion not in favor of FIFA..... People having a so long  experience in the sport fairness, it is expected to have an higher attitude in recognizing when they are loosing (:-)
there are 2 sides of this coin..........
one is The FIFA is correct in protecting it's sponsors.
and the 2nd is Ambush Marketing is gaining huge publicity out of this dispute.

FIFA's sponsors have paid a huge amount to get the advertising rights for the World Cup. If other companies also advertise and it is detrimental to the main sponsors, next time no sponsor will come forward for the advertising rights unless ad protection is provided. This protection clearly highlights the stand that the FIFA and the government have adopted. It is obvious that any body who funds another agency initiative will expect the organizers to ensure their return on investment (ROI)......

FIFA HAS ACTUALLY GIVEN FUEL TO FIRE BY HIGHLIGHTING THIS ISSUE. BAVARIA WINS HANDS DOWN.

The FIFA is correct in protecting it's sponsors. However, the dresses hardly show the brand Bavaria which makes the resulting action too much. It is childish of the FIFA to say the least and they provide Bavaria with more advertisement, just by making the arrest. The fact that the laws have been changed on request of the FIFA is outragious.

It is rumoured that for the coming EK, the same law-changes in the hosting country are requested/demanded by the FIFA.
It clearly shows that these tournaments are a commercial event only and no longer revolves around the sport.
