RIGHT TO EMPLOYMENT OF EMPLOYEES UNDER SUSPENSION AND RETRENCHED/REMOVED  EMPLOYEES.

1.KINDLY NOTE THAT EMPLOYMENT CONTRACT IS IMPORTANT.THE TERMS AND CONDITIONS OF EMPLOYMENT ARE WRITEN IN THE EMPLOYMENT CONTRACT. ANY BREACH THE AGGRIEVED PARTY CAN MOVE THE PROPER COURT.

BUT DUE TO RECESSION SEVERAL EMPLOYEES ARE FACING PROBLEM OF LOOSING THE EMPLOYMENT ON SOME FALSE AND FICTITIOUS REASONS. THE POOR FAMILY MEMBERS INCLUDING WIFE AND SMALL CHILDREN  WHO ARE DEPENDING ON THE EMPLOYMENT OF THE EARNING MEMBER OF FAMILY , THE ENTIRE FAMILY HAS TO FACE PROBLEMS DUE TO SUDDEN LOSS OF JOB. THE REASON GIVEN MAY BE SUSPENSION, RETREANCHMENT /REMOVAL FROM EMPLOYMENT.THE POOR FAMILY CAN NOT REPAY THE LOAN INSTALMENTS FOR HOUSING AND OTHER LOANS AND HENCE THEY HAVE TO FACE HARDSHIPS AND LOSS OF HOME DUE TO NON PAYMENTS OF HOUSING LOAN INSTALMENT WHICH IS THE RESULT OF LOSS OF JOB.

KINDLY NOTE THAT REMEDY FOR THIS IS URGENT FILING OF WRIT PETITION IN THE HIGH COURT MENTIONING ILLEGALITIES OF THE SUSPENSION/RETREANCHMENT/REMOVAL FROM EMPLOYMENT.THE AGGREIVED PERSON MAY FILE APPLICATION TO LABOUR AND INDUSTRIAL COURT IN CASE HE COMES UNDER INDUSTRIAL DISPUTES ACT.

IT IS THE RESPONSIBILITY OF THE CENTRAL AND STATE GOVT.ALSO TO KEEP STRICT CONTROL ON THE LOCAL EMPLOYMENT PROBLEMS AND ALSO ILLEGAL SUSPENSION /RETRENCHMENT/REMOVAL OF EMPLOYEES .WHO ARE THE VOTERS AND HAVE ELECTED THE GOVT.REPRESENTATIVES  OF LOK SABHA AND ALSO THE STATE GOVT.

KINDLY NOTE THAT SEVERAL EMPLOYEES ARE NOT PAID THE SALARIES ON FAKE GROUNDS OF SOCALLED RECESSION. THERE ARE MEASURES AVAILABLE TO FIGHT RECESSION .SUSPENSION .RETRENCHMENT AND REMOVEL OF INNOCENT EMPLOYEES AND MAKING INJUSTICE ON THEIR POOR PARENTS ,WIFE AND SMALL SCHOOL GOING CHILDREN AND MAKING THEM HOMELESS IS NOT THE SOLUTION OF THE PROBLEM.

I INVITE COMMENTS OF ALL EXPERTS IN  DIFFERENT FIELDS TO CONTRIBUTE AND COMMENT SO THAT AN APPROPRIATE PUBLIC INTEREST LITIGATION CAN BE FILED IN APPROPRIATE HIGH COURT.

I have seen Many of whom i know who have lost their jobs and the reason given was recession, and some of the companies even when they had no affect to recession just removed their employees citing the same reason, so many of them who had taken loans are in spot of bother and are not able to lead a normal life and this is affecting their family a lot and there are thousands of them who are facing the same situation...but on the other side if the organization is not in a position to take back their employees due to genuine reasons like resource crunch then what should be done Nandakumar??? we need to look at both the sides.......

i personaly appriciate your  view and suggest that  this matter can be  a subject matter of the public intrest litigation. it my view that on this matter only suprim court of india  have jurisdiction becouse of the recession is not the problem of the one stateits a entire indian fenemina. if you know and you have primafacia  evidence. you could move forword. i am with you  you can call me for the help my mobile no is 09871019558......... i will give you resion and point  for the locus stavdie befor the court.
