A franchisor is an individual or company that enters into contractual agreements and allows others to adopt a business model and sell trademarked products or services. In return, the franchisee must pay royalty fees and help contribute to the advertising budget of the overall business. These business ventures have become very popular, but they are not without problems. Sometimes, issues between the franchisor and franchisee lead to legal disputes.
Here are some of the steps you need to take in order to properly handle any legal disputes you may have with your franchisor:
- The best thing you could do is to always keep accurate and very detailed records. This includes verbal and written conversations, email documentation and any franchise paperwork you have ever received.
- One place to look is the franchise legislation set by the Federal Trade Commission. Here you can find plenty of useful information pertaining to your rights as a franchisee.
- You're best bet is to find a lawyer specializing in business law with experience in franchising.
- Once, you've an experienced lawyer to take you case, talk over your legal dispute with them.
- While all of your legal proceedings are going on, it is best for your business that you continue to run operations as you would any other day.
You're still under contract with the franchisor so you'll still be expected to honor any agreements made previously.
If you follow these points, then I am sure that you will be protected from all negatives of teh dispute and also your loss will be bare minimum.
