UPA Relief on 2G Case

The United Progressive Alliance (UPA) government got some major relief on February 4, just days before the first phase of polling for the Uttar Pradesh assembly polls, as Special Judge O. P. Saini dismissed Janata Party President Subramanian Swamy’s petition seeking to make Union Home Minister P. Chidambaram a co-accused in the 2G spectrum allocation scam. The court’s verdict has provided some succor to the government, which was acutely embarrassed this week by the Supreme Court’s cancellation of 122 2G spectrum licenses issued in 2008 by the then-Telecom Minister A. Raja. The latest verdict is a distinct boost for a government that has been mired in corruption scandals.

The judge held that there was no case against Chidambaram and declined Swamy’s plea to be allowed to give more reasons for the order. The 2G trial will resume from February 17.

Judge Saini’s 66-page verdict makes two very significant observations that should be music to the UPA leadership’ ears: “Anybody and everybody associated with a decision in any degree cannot be roped as an accused,” and “One cannot be held guilty merely by association with a decision, and a decision by itself does not indicate criminality.”

Saini said there was “no evidence on record” to suggest that there was an agreement between Chidambaram and to subvert telecom policy and obtain pecuniary advantage for himself or for any other person. “There is no evidence of any substantive act being committed by him (Chidambaram)…Innocent and innocuous acts done in association with others do not make one a partner in crime, unless there is material to indicate otherwise, which is lacking in this case,” the judgment read.

Unfazed, Swamy announced that he would be going to the High Court within the stipulated three months’ period to appeal against the trial court’s verdict, and vowed to garner more “evidence” against Chidambaram and then-Congress President Sonia Gandhi. Swami had argued that it was the duty of Chidambaram as finance minister to prevent Raja from going ahead with auctioning off 2G spectrum licenses at throwaway prices, a moveestimated to have cost the exchequer about $36 billion at current prices.

The Congress, as was to be expected, hailed the judgment, while the Bharatiya Janata Party maintained that the order wouldn’t impact its campaign against Chidambaram as there was “clear evidence” against the minister. The Communist Party of India (Marxist) demanded a statement from Prime Minister Manmohan Singhonthe issue.

The judgment comes as India’s most populous and politically crucial state of Uttar Pradesh is about to start the first of its seven-phases of polling. Of course, whether the Congress is able to extract tangible political benefits from this court order will be known only on March 6, when results for the five states’ assemblies will be announced. However, the decision is certainly a boost for the party, and means there’s no immediate threat to its survival at the center.

The worst thing what the country had witnessed was the manner in which the media covered the whole episode with a running commentary (second by second). Each one was expecting the most sought after verdict in favour of Subramaniam Swamy, as had happened in the Supreme Court a couple of days earlier. But, ended on a very sad note! Finally, the verdict has come from the lower court, which may be contested by Subramaniam Swamy at higher courts. This judgement, however, has brought in a sigh of relief for Congress for the timebeing, as the decision against PC would certainly have tilted Congress's balance in the ensuing UP elections!

Well said Mr. Vinay.  Sporadic incidents do happen now and then.  For that  we cant blame the entire institution(s).   Let us repose confidence in the system for the country sake.

Sureshji, i think as a responsible citizen you should not be casting aspersions on institutions like SC. The politicians are doing a pretty good job dismantling important institutions. At least we can for our country and our own posterity maintain some decorum.

Well said Mr. Vinoy.

When a person having leanings towards a particular party, he/she could able to look at the brighter side (rather blinking side).  Whereas those who dont have any leanings can look from all the dimensions and particularly the darker side which was hitherto left out.

The last word is definitely not out on the 2 G scam. But I think it is best left to the investigation agencies. The court is seized of the same. As for nobody being brought to book - Surely Raja is not having a rollicking time in the cell. Sure none of us want to switch roles with him today. 

And if any further strictures do come on any other individual - be it a minister or another power broker, they should meet the same fate. Remember the case is still sub-judicial and we have a ex central minister of cabinet rank behind bars for a year. Surely it is not that wheels of justice are not moving. 

The pace may not be to the liking of every individual. But we cannot run the affairs of the country satisfying the perceptions and leanings of every individual. Let the law take its own course.

It is too early to call it  day on the matter. That rules were bent and lot of money changed hands is already established albeit not at a pace many would have liked it to happen. At best it is a short reprieve as Mr Raja can not be held solely accountable in isolation. 
Compare.............cabinet to a human body and imagine someone saying my hand took the bribe the rest of body had no role.

Who had been signed to sanction those all licenses without any national responsibility? Why any minister is not punished?

Srinivas! I do not know if your comment was fast one pulled on me. But to be frank, my degree of elation is higher than the degree of congressmen relief or BJP's disparagement. I am glad that the strings that blinded the truth is coming apart. Part by part. As a truly modern Indian citizen, I cannot be held back by policy paralysis and negativism. I want progress and good governance. Lolz

The judgement on PC in 2G scam bears testimony to the fact that a mountain has been sought to be maid of small time molehills. One gets the feeling that the Team Anna attempts, Advani's rath yatra, Modi's sadhbhavna yatra and constant interruptions in parliament are part of a concentrated effort to bring the elected government to a paralysis.

This if true, is a sad phase in our democracy. The BJP should remember that it is the people of India who have brought UPA to power by virtue of universal adult franchise. It also has entrusted the BJP with the responsibility of the Principal opposition and hence should act accordingly. 

Power if it befits them will come to them after the next general elections or when the congress led government falls under its weight. Secret manipulation do not have a place in a democracy of universal secret ballot.

The BJP will serve its own good if it respects the fact that the governments are formed and tested on the floor of the house. Even our comrades in Bengal and Kerala have realized of this truth. Or do we see a RSS hand behind this?

I agree with Makesh and Vinoy. Govt. did do a few things wrong, but indictment of Raja is the end of it. Subramanian Swamy just don't have a case but he still tries and misrepresent facts.

It was definitely blown out of proportion but I cannot understand why this government give this media space & time. Too much time and resources was spend on wining over the media and cooling media induced frenzy. This has partly led to the political paralysis and India  is going to pay for it in next couple of years.

Frankly it was a media created scam. Except for insider info given to companies by minister and bureaucrat there is nothing to condemn it. The loss to the exchequer is nil. Period. As the government policy was always telephone penetration and not income generation.
