I understand that Central Information Commission (CIC) has asked the Supreme Court (SC) to explain the rationale behind a certain judgement. When Supreme Court gives a judgement, we consider it as final and binding. The judges normally express the rational behind giving such judgement.
Do you think CIC has a right to ask SC to explain the rational behind a judgement. Does it not amount to interefering in the functioning of the Supreme Court ?
There is nothing worng in CIC asking Supreme Court to give rational behind a Judgement. Even you and I can ask them. We call it by different Name to respect the Judiciary. Normally COurts give eleborate reasoning nehind a judgement while delivering it. if they dont and or you are not satisfied you can file rvivew petition. and ask for a full bench to go throigh it again and the courts doesnot get offended by it. it is the duty of the courts to give such explanations and normally it is part of a judgement. So one need not make an issue out of such things. COurts always accept such things if you have a reason behind it or you have knowledge of more information. They welcome it.
When the judgement is read, in toto,all the details (Iincluding the genesis, arguments,reason and rationale in coming to certain assumptions and conclusions etc. etc) are either included or appended in a systematic and laborious manner. Normally, it is final. Sometimes, S C may review its own position. But, that is rare.
