a company doing infrastructural project distributes the job among several contractors. the contractors , for example, procure concrete from a company on credit. they give cheques and they return for insufficient funds. when the supplier contacts the contractor, he pleads helplessness. Now the supplier has no access to the material supplied since the material will be lying in the custody of the infrastructural company which has engaged the contractor.
how can the supplier recover money from the contractor.
by this time the contractor would have received full payment from the company and quit the site too.
why courts cannot ensure justice to such suppliers and leave them at the mercy of such unscrupulous contractors.
is there a possibility of reserving the rights of the material supplied till the supplier recovers the full amount.
is there a possibility of getting a clearance from the supplier for being paid for the material by the contractor before the company settles the dues to the contractor fully.
