Hi,

  I  joined  infosys technologies on 02-Aug-2010 as a system engineer trainee and undergone training in Infosys Mysore campus. After  successful completion of training(training got over in the month of Dec 2010) I have been posted to Hyderabad SEZ(Special Economic Zone) infosys campus as a system engineer .During the training i have signed a Bond which stands valid for one year from the date of joining the unit(as i am in unit from january 2011) . My contract with company clearly states that i have to pay money in case i choose to leave during that one year. As i am an aspirant of GATE(Graduate Aptitude Test in Engineering for M-Tech ) 2012 , i am unable to find time to study for the exam. So i have decided to leave the company and start preparing for GATE exam.

My question is

 1. As  calculated the Bond amount  comes up around 3.5 Lakhs , i cannot afford to pay this huge money. can company sue me if i tender my resignation and refuse to pay the money?

2.please suggest me how can i leave the company without paying them?

3.Are they going to Black List me in NASSCOM ?

Yes, the employer can sue you for recovery of the amount as you have bound by agreement to pay that amount on leaving your job. Besides, the company can also intimate your details to NASSCOM from where other companies,before offering you any job, can verify from NASSCOM that you have already deserted a reputed company by trying to back-out from the agreement. That would be harmful to your future career. Besides payment of bond amount, you may also have to bear with the litigation expenses, if a court case arises. So, you would be lose on all the fronts, if you leave job now.

So, it is advisable for you to leave the company honorably only after the bond period is over.

However, if you feel that after enhancement of your qualification to M.Tech can provide you better job prospects, you may try to convince the management and request them for relaxation of the bond period, if they can. Otherwise you may have to compromise with your position by paying the bond amount.

The other alternative is, if the cost of your first year of M.Tech is not much as compared to your bond amount, continue with your service with gradual continuation with your preparation for GATE, as much as you can, and take the GATE for 2013 instead of for 2012. Resign after one year of service to take up your studies with full zeal without any tension after that. That way you won't need to pay 3.5 Lakhs as contract amount. However, you will have to lose 1 year in continuing your studies.

So, weigh the pros & cons of the suggested alternatives, take a wise decision, and act on the alternative that suits you the best.
