Should paying bribes be legalized?

India’s chief economic adviser Kaushik Basu suggests a radical solution to put an end to corruption scandals. He argues that decriminalizing bribery would put the interests of both the bribe giver and taker at odds resulting in lesscorruption. Is there any other alternaive? Will this put an end to corruption?

Hi Tina,

Actually what Kaushik Basu's paper says is that when the bribe-giver has been blackmailed into giving a bribe, she/he should not be treated as a criminal. Rather the bribe-taker who was harassing the bribe-giver should be treated as the criminal. For example, if a farmer's crops are seized by a government functionary and out of hunger and thirst the farmer gives some money to the functionary then the functionary is at fault. Therefore, the court must only prosecute the functionary, and the farmer can be treated as a witness instead of being the defendant in the courtroom.

Before I can say a NO, tell me how are you going to account it!  BLACK ECONOMY is not a thing of politicians alone!!  Citizens are also very much party to that.

Why I said let me introspect before I say a NO is, let us take a case of legalized bribery!!  

Fundamentally 1. How is it going to be legalised?

2. Who sets the percentage?

3. If you know about law of contracts, then who sets accountability to the actions promised under a bribe?

4.  How is the collected amount going to be paid?

5.  How is the paid amount going to be accounted?

6.  Will it act as deterrant or a promoter of corrupt practices?

7.  Macro question - WHAT IS INDIA's image going to be in the international arena??

So technically, even if we think of doing it, its like opening a CAN OF WORMS or PANDORAz BOX!  Since we will have to rewrite our entire constitution to do that!  So rather than saying NO it better to say DON'T THINK OF THE IMPOSSIBLE!!

No:If we wish to curb this practice i have a solution.

Accepting bribe should only be recognized as an offence,because it is the duty of the officer to remain loyal to his job.

This is mainly to subsidize the blame game from the "giver" and the "acceptor" of bribes.

The penalty for accepting bribe should also be made tough.

No Tina it is ridiculous It is the time to kick-out corruption from our system. Yes people have frustrated in rooting out corruption has ironically mentioned about it but it is not the solution.  This is the dangerous thinking as it may lead other things to follow like Prostitution,Drugs,etc. for legalization.

If the rape is inevitable, why not enjoying.. it reminds me of that. There are 511 sections in IPC codifying whole spectrum of crime against the society. Legalization such thing would mean one more crime against the society, which is uncalled for.

Its anyway seems to be legalized in India. But on the moral standpoint, anything unethical should not be legalized, C'mon, if you legalize bribes, then why not rape, human trafficking and prostitution with the reason to reduce rape cases etc. That is an absurd and ridiculous argument.

Bribe is unethical and should not be legalized, rather it should be controlled by stricter mechanism by stronger functionaries.

I think, neither bribe paying nor bribe taking should be legalized.The legalization will not stop the people from taking/paying bribes.Our psychic has been immune to all form of bribes against time and space.

Before taking a stand, let's analyse the two situations where bribing is decriminalised and where it is not. We cannot deny that, in the current scenario, bribing is pretty common and, in fact, it is considered to be lubricating the economy. Most people don't mind paying some amount as bribe in order to get their work done in the given time and in the manner expected. It only hurts when the thing gets dealayed or is not done in the manner expected or when the bribe demanded is too much. Also, since the issue is confidential, the person paying the bribe and the person receiving cannot easily get into an agreement as to the amount to be exchanged. In the scenario where it is decriminalised, there comes into picture the benchmarking of bribery in terms of the amount demanded, the time taken and the level of effectiveness. The knowledge on all these areas becomes public. Some kind of competition and some amount of pressure starts acting on the party receiving the bribe. Market economics will come into picture, the bribe amount will be settled at a reasonable level and the performance standards will be set. All this will make things move much faster and this, in turn, will impact the economy in a very positive way. Thanks, Tina for the referral.

I do not think it will stop people from indulging it. We need only to devise a way to minimize it at-least. Pinch of corruption(bribes) harps many, mainly, because millions are unable to pay it when they harshly demand it. When a poor goes to VAO for community certificate for Scholorship, the official may demand Rs100/ to render it. But, the question is," does he has that to pay at that very moment? particularly, when he is starving for a square meal. Now tell me, how the bribe can be legalized.
