Hello Mr. V.durga Rao,
I hope if you have come on a Social Networking site like TooStep for discussions (even though you must be a busy MAN), you would certainly like to enlighten people with your knowledge of LAW.
Though I do understand a Lawyer will not give a free ADVICE to anyone, I would still like to ask you, what does it mean to be a LAWYER????
Whether the job of a LAWYER is to uphold the rule of LAW (TRUTH) in the country or to look towards the other side when the miscarriage of LAW takes place????
It is a Lawyer who presents the TRUTH to the Judge, who then gives Judgement in favour of one or the other side. I would say that a JUDGE is just like an umpire in a Cricket Match. If a team has lost the match, we can't blame the Umpire for the loss.
So according to my understanding, it is only a LAWYER who can uphold the rule of LAW in the country.
What if a LAWYER gets to know that the client who is paying the fees is actually wrong (a criminal)????
Should the LAWYER go against his own client????
or
Should the LAWYER put an innocent individual behind bars just to add another WIN in his/her professional career or for the sake of his/her own "fees" and sell the TRUTH????
And if a Lawyer actually puts an innocent person behind bars (knowingly) and later the TRUTH is revealed, can any action be taken against the LAWYER....
Is their any PRECEDENT that you can share with all of us????

But I am not asking about a scenario of a person who is "criminal" only in the eyes of the Public.
I don't think any LAWYER could fight a case without knowing the whole TRUTH.... So what I am asking is, if the client himself/herself accepts in front of his/her Lawyer that he/she is the real culprit or in the course of the case the LAWYER realises this fact, then what should the LAWYER do????
If I would have been a LAWYER, I would take up the case of this Criminal. I will ask every detail about his/her CRIME and then will share all these proofs in a secret meeting with the JUDGE and the PROSECUTION LAWYER. I will loose the case deliberately.
This way, I get my fees, the real culprit gets what he/she deserves and the RULE of LAW will be upheld in the country....

Asking direct questions with direct answers is better than taking out interpretations from something which is written and said in some other context.... Well Balram, though this question is for Rao sir (Whose reply I am also waiting for), But as a lawer I would like to say something regarding this issue. If a lawyer is really honest, Say for example, someone like Gandhiji, all the points you gave is really valid. Yes, it is true, as a honest responsible man, he shouldn't help criminals. But when it comes to profession, a modern day lawyer just defends his candidate. Many a times a candidate, in the eyes of the whole public may be criminal, but in general, he may not be, which, only he knows but is not able to convience anybody. There may be circumstances which compelled him to do the crime or he may have been given a wrong blame. In that condition, isn't it the duty of a lawyer to save that "public eyed" criminal? or else who will protect that innocent to whom all the evidences are pointing as a criminal.
Now come to other part, when someone chooses law as a career in modern day, he can't wait for 100% pure man to approach to whom he will defend. Yes, if he finds one, he should definitely help without bothering about the money. But will he only wait for that type of person? who is 100% innocent in today's date ? No one....In that case, what will be the future of our profession???
