Land Acquisition is most controversial issue in present days of economic growth. The process of land acquisition are not transparent and it is the middlemen who play with Govt,,Business Houses and Land owners, since this is very complex issue and most of times the land owners are the worst sufferers as they do not get the right compensation which they deserved.
Why until now, after so many land reforms and agitations we have not a strong regulatory mechanism to address theses issues and LAnd acquistion Act as per present times.
It is basically depends upon the willingness of political leaders & members of the parliment, as they have more interest to keep the same laws which had been incarporated in 1894 , as they are in fear to loose their acquired land, as most of the land @ villages are forcefully taken as mortgage from the money lenders. savkars/ jamindars. & all these money lenders & jamindars are either associated to these political parties or they themselves have this profession @ their home.
Ravindra Sir, Quite rightly said. But as per everyone knowledge,we need large amount of area for constructing manufacturing facilities to grow the economy and there are large number of restrictions on forest, adivasi, and agriculture land etc put by Govt.Although the govt has to ensure the benefit for all the sections of society as it should not facilitate one section at the cost of another.
if new Rules and regulations, which keep in mind the emotional and financial pain the people suffer while surrendering their lands and restoration/rehabilitation of the affected with ease and at proper place, can very much put an end to the disputes. The people are directly compensated without much interference from political parties ,which reap large unscruplous profits from such acts can help further.
Dear Arun,
This is not the only law that may not even be worth the antiquity value of paper yet ask the person whose land gets grabbed and see what it means to whomsoever it inflicts miseries.
For this section Independence and freedom suddenly become meaningless words.
Share with us one single law that has been enacted or altered post independence and has gone on as effective and useful to nation and its citizen. One has to work really hard to find one as almost all laws are changed to benefit at best an individual, group or section of people. And laws that are in interest of larger interest are mostly good in books.
As per Law ministry's drafting panel there is going to be land acquisition in ratio of 70:30 where private has to acquire 70 percent of land against NAC(National Advisory Council) stand that govt should go for 100 percent. There are number of serious issues there like Resettlement and Rehabilitation etc.let us see how much compensation the draft bill accommodate for farmers and how much useful it becomes for the other stakeholders.
Thanks for the insight, and there are also issues regarding resettlement and rehabilitation of PAPs.
I would like to know more regarding, under whose purview the R& R responsibilities lies with?Is it state govt or project company..
Moreover, where ever there has been issues of land acquisition like in Posco case Orrisa ,number of NGOs and social activist have played key role in moulding public opinion.
DO we have a think tank or policy making bench at Govt who can look into all these issues and take decision in interest of people and country at large.
The land acquisition (amendment) bill 2007 is still pending to be passed in the Parliament. The Supreme Court recently told the Government of India to dump the archaic Land Acquisition Act, 1894, to prevent Nandigram-like violent protests in every State. The Apex Court has warned the Government that it would step in to safeguard public interest, if the authorities failed to do the needful. The Vacation Bench of Justice P. Sathasivam and Just A.K. Patnaik said "The perspective has to change. The public purpose clause in the 1894 Act must go. If the government does not do it, then this court has to act. It is development of few at the cost of many".
