Indian Contract Act really codifies the way we enter into a contract, execute a contract, implement provisions of a contract and effects of breach of a contract. Basically, a person is free to contract on any terms he chooses. The Contract Act consists of limiting factors subject to which contract may be entered into, executed and breach enforced. In day-to-day commercial transactions, we will enter into many agreements or contracts. While certain agreements are prepared mechanically and get executed, certain other agreements require careful consideration of many things. For example, a sale agreement contains standard clauses and in many cases it is prepared mechanically barring the change in name of the parties, the schedule, the consideration etc. And, again, it is not the case with a complicated lease transaction which contains many details. The agreement or the contract is the basis for the parties concerned to protect their rights by approaching a court of law in case their rights under the agreement are violat...

From 15th June 2011 Every Advocate shall be entitled as of right to practice before any court in India including Supreme Court. Section 30 of the Act says: “Subject to the provisions of this Act, every advocate shall be entitled as of right to practise throughout the territories to which this Act extends; in all courts including the Supreme Court; before any tribunal or person legally authorised to take evidence; and before any other authority or person before whom such advocate is by or under any law for the time being in force entitled to practise.
