I am sharing a very important  policy decision of GOI on PROCUREMENT AND PURCHASES...aka ..Anna Hazare Effects. For first time ,PP model is also being put to good effects i procurement. 

I am reproducing an extract of news item as under

Procurement law to battle graft

NEW DELHI: In a move aimed at rooting out corruption from lucrative contracts, the government is expected to draw heavily from the model UN (United Nations) law while drafting India's public procurement legislation, which will also cover public private partnership projects, a top government official said.

I request readers to share their views whether departure from an all time procedures will will be fruitful and effective,

@Mr Munshi Ramchand, I agree with your argument.The system which to be developed is of involving third party in supplies.PPP Model will best suit to capital machinery or heavy machinery mainly used for manufacturing ancillary products.It can boost agriculture and infrastructures.I want you to write few suggestion for developing a system involving PPP and Government.

This need not be true always. What if I know how to fool the system inspite of transparency?. Yes, it is true that transparent systems are less prone to corruption but it is not perfectly insulated from corruption. There are plenty of nations in this world, plenty of organizations in this world where there is no RTI, nobody to question and YET there is no corruption. So, the corruption in procurement and purchases in India can be rooted out ONLY by Indians - no amount of law and transparency is going to do any good.

How the system will be evolved will largely depend on policy makers.Taking clue from Mr Srinivas and Mr Muralidharan' comments,I believe that Government must place minutes of meetings on line immediately after finalizing the agency.The eligibility criteria. resourcefulness,financial standings,penalties,supply credentials all must be on line and with wide publicity.And many other things including on line down loading facility of tender documents.And what Mr Muralidharan expected under a "Nodal Officer". This will ensure all important three elements competition,transparency and integrity to Mr Srinivas expectation.
I would like readers and contributors to come up with their own proposal as to the policy to be drafted by the Government.
Policymakers crafting a sound procurement system must balance a number of goals. Of those goals, experience has shown that competition, transparency  and integrity are probably the most important.  If a government's procurement system reflects all three elements, the system is much more likely to achieve best value in procurement, and to maintain political legitimacy.  These central goals, moreover, complement one another.  A fully transparent procurement system, for example, is far less likely to have problems with integrity, for many more stakeholders can exercise oversight in a transparent procurement system.  The reverse is also true:  a system with weak systems to enforce integrity, for example, will probably have shoddy competition, and transparency will likely erode as corruption drains the procurement system of political legitimacy.


UNCITRAL (United Nations Commission on International Trade Law) an important instrument for harmonizing, and strengthening, procurement system includes anti-corruption provision.  It would be an effective system of sanctions against corruption by Government officials, including employees of procuring entities, and by suppliers and contractors, which would apply also to the procurement process. 

But, how it works in India depends on the commitment of the Govt. to control the corruption.

Thanks Mr. Baksh for sharing this very important policy decision.  This reminds us on an old adage "learn from the past" lest they repeat the same follies and be damned. PPP model for infrastructure in India, the Government should strengthen co-ordination between the Departments and the Private Partners by setting up a "Co-ordinating Agency" or a "Nodal Officer" exclusively for such projects.
